STATE OF GEORGIA COUNTY OF GLYNN NOTICE OF SALE UNDER POWER Under and by virtue of the power of sale contained in a Security Deed from DAVID L. HICKS, SR. to UNITED COMMUNITY BANK, dated August 26, 2003, recorded August 27, 2003, in Deed Book 1233, Page 346, Glynn County, Georgia records, as last modified by Modification of Security Deed dated March 7, 2006, recorded in Deed Book 1895, Page 434, Glynn County, Georgia records, said Security Deed being given to secure a Note from DAVID L. HICKS, SR. dated March 7, 2006, in the original principal amount of Thirty Six Thousand Two Hundred Ninety Four and 53/100 ($36,294.53) Dollars, together with interest thereon on the unpaid balance until paid; there will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door at Glynn County, Georgia, within the legal hours of sale on the first Tuesday in September, 2015, the following described property: All that certain lot, tract or parcel of land situate lying and being in the City of Brunswick, Glynn County, Georgia, therein and known and designated upon the well known maps and the plan and particularly the map known as Baldwin's Map of said City, as the Southwestern forty by fifty-five (40 x 55) feet of Old Town Lot Number Four Hundred and Sixty-Six (466), said tract hereby conveyed being rectangular in shape, and beginning at the Northeastern intersection of Albany and Monk Street, thence running easterly along the Northern side of Monk Street a distance of fifty-five (55) feet, thence at right angles in a northerly direction a distance of forty (40) feet, thence at right angles in a westerly direction a distance of fifty-five (55) feet, to the eastern side of Albany Street, thence in a southerly direction along the eastern side of Albany Street a distance of forty (40) feet to the initial point. Reference being made to said survey for all purposes of description and identification of said property. Parcel ID: 01-01724 The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the Security Deed and by law, including attorney's fees (notice of intent to collect attorney's fees having been given). Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, easements, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
