CLASS:007 NOTICE OF SALE UNDER POWER STATE OF GEORGIA COUNTY OF COWETA By virtue of the power of sale contained in a Deed to Secure Debt given by Ray Stephens in favor of Jason C. Prowell, dated August 31, 2003, and recorded in Deed Book 2338, Page 672, Coweta County, Georgia records, conveying the property described herein to secure a Note in the original principal amount of THIRTY SEVEN THOUSAND SIX HUNDRED SIXTY TWO & 00/100 DOLLARS ($37,662.00) with interest thereon as set forth therein, there will be sold at public outcry for cash to the highest bidder before the Courthouse door of Coweta County, Georgia, between the legal hours of sale on the first Tuesday in September, 2015, the following property, to-wit: ALL THAT TRACT OR PARCEL OF LAND lying and being in Land Lot 47 of the 6th Land District of Coweta County, Georgia, and being more particularly described as follows, to-wit: TO REACH THE TRUE POINT OF BEGINNING commence at the common corners of Land Lot 18, Land Lot 19, Land Lot 46 and Land Lot 47 in the aforesaid District; running thence in a northerly direction along the West Land Lot Line of Land Lot 47, aforesaid, 212.57 feet to a point; running thence South 87 degrees 35 minutes 36 seconds East 591.70 feet to a point; running thence North 02 degrees 17 minutes 42 seconds West 1200.00 feet to a 3/8 inch rerod found, which said point is also the southeast corner of property owned by the Grantee herein; running thence North 02 degrees 17 minutes 42 seconds West 95.50 feet to a 3/8 inch rerod set and the TRUE POINT OF BEGINNING; from said True Point of Beginning thus established, running thence North 02 degrees 17 minutes 42 seconds West, along the eastern property line of other property owned by the Grantee herein, 923.59 feet to a 3/4 inch alum pipe found located on the southerly right of way line of Kelly Farm Road (60 foot right of way); running thence South 84 degrees 17 minutes 25 seconds East 51.81 feet to a point; running thence South 87 degrees, 16 minutes 47 seconds East 63.58 feet to a point; running thence South 89 degrees 16 minutes 11 seconds East 62.99 feet to a point; running thence North 80 degrees 31 minutes 02 seconds East 90.90 feet to a point; running thence North 63 degrees 34 minutes 48 seconds East 52.72 feet to a point located on the southerly right of way line of Kelly Farm Road, aforesaid; running thence South 00 degrees 14 minutes 03 seconds East 940.87 feet to a point; running thence South 87 degrees 40 minutes 31 seconds West 282.01 feet to a 3/8 inch rerod set and the TRUE POINT OF BEGINNING; being a 6.277 acre tract of land all as more fully described on Plat of Survey for Jason Prowell, dated June 16, 2003, by Christopher Brothers Surveyors, Registered Land Surveyors, which said Plat of Survey is incorporated herein and made a part hereof by reference thereto. The debt secured by said Deed to Secure Debt having been declared due because of, among other possible events of default, failure to make payments as and when due under the terms of said Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, including reasonable attorney's fees, notice of intent to collect attorney's fees having previously been given. To the best of the knowledge and belief of the undersigned, equitable title to said property is held by Ray Stephens, or a tenant or tenants. Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Deeds to Secure Debt.
