NOTICE OF SALE UNDER POWER Georgia, Ben Hill County Under and by virtue of the power of sale contained in that certain security deed from RONALD J. PARKS, to Colony Bank-Fitzgerald, dated JULY 23,2010, and recorded in Deed Book 757, at Pages 148-152 on AUGUST 06, 2010, in the office of the Clerk of the Superior Court of BEN HILL COUNTY, Georgia, and further by virtue of the default in the payment of the in- debtedness secured by said deed to secure debt, and for the purpose of paying the indebtedness secured by said deed to secure debt together with the costs of sale and together with attorneys' fees as provided by said security deed, proper notice of the enforcement of the same and of intention to collect attorneys' fees in accordance with the terms of the note secured by said deed having been given to the said RONALD J. PARKS, there will be sold by the undersigned before the Courthouse door in BEN HILL COUNTY, Georgia on the legal sale day on SEPTEMBER 1, 2015, between the legal hours of sale to the highest bidder for cash the following described property, to wit: ALL OF FIVE ACRE TRACKS 15 AND 16 IN LAND LOT 264 IN THE FORTH LAND DISTRICT OF FORMERLY IRWIN, NOW BEN HILL COUNTY, GEORGIA , AS SHOWN BY THE PLAT OF THE COLONY DOMAIN MADE BY OR FOR THE AMERICAN TRIBUNE SOLDIERS COLONY COMPANY ON FILE IN THE OFFICE OF THE CLERK OF SUPERIOR COURT OF IRWIN COUNTY, GEORGIA. Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior the security deed first set out. Said property to be sold as the property of RONALD J. PARKS by virtue of the powers and authority contained in said deed to secure debt in favor of the undersigned for the purpose of paying the indebtedness secured thereby and the proceeds of said sale shall be applied to the principal and interest owing, the expense of said sale, including attorneys' fees, all as provided in said deed and the balance, if any, will be held for the account of said debtor.
