NOTICE OF SALE UNDER POWER
Because of a default in the payment of the indebtedness secured by a Security Deed executed by John A. Connor to Wells Fargo Bank, N.A. dated August 10, 2011, and recorded in Deed Book N37, Page 286, Rabun County Records, securing a Note in the original principal amount of $300,000.00, the holder thereof pursuant to said Deed and Note thereby secured has declared the entire amount of said indebtedness due and payable and, pursuant to the power of sale contained in said Deed, will on the first Tuesday, August 4, 2015, during the legal hours of sale, before the Courthouse door in said County, sell at public outcry to the highest bidder for cash, the property described in said Deed, to-wit:
All that tract or parcel of land lying and being in Land Lot 170 of the Second Land District of Rabun County, Georgia, and being designated as Lot 209, containing 0.40 acres, more or less, of land and Lot 209 A, containing 0.32 acres of land, Part 3 Ridgepole Area, Sky Valley Subdivision, as shown upon that certain plat of survey dated January 2, 2002, prepared by William F. Rolader, Georgia Registered Land Surveyor No. 2042, said plat being recorded in Plat Book 47, Page 71, Clerk's Office, Rabun Superior Court, reference to said plat being for the express purpose of incorporating its description herein.
The above-described property is conveyed subject to the encroachments of a planter and a patio into the road right of ways as shown on the above-referenced plat, and such easements, as may appear of record or actually existing upon said property.
This conveyance is made subject to that certain declaration of restrictions dated January 8, 2980, and recorded in the Office of the Clerk of Rabun Superior Court in Deed Book J-7, Pages 553-559.
TOGETHER WITH THE FOLLOWING PARCEL:
All that tract or parcel of land lying and being in Land Lot 170 of the Second Land District of Rabun County, Georgia, and being designated as Lot #210, Part 3 of Ridgepole Area, Sky Valley Subdivision, as shown upon a plat of survey recorded in Plat Book 15, Page 266, in the Office of the Clerk of Superior Court, Rabun County, Georgia.
Said property is known as 15 Downing St. #516, Sky Valley, GA 30537, together with all fixtures and personal property attached to and constituting a part of said property, if any.
Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, whether or not now due and payable), the right of redemption of any taxing authority, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
The proceeds of said sale will be applied to the payment of said indebtedness and all expenses of said sale as provided in said Deed, and the balance, if any, will be distributed as provided by law.
The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the secured creditor.
