NOTICE OF SALE UNDER POWER IN SECURITY DEED

G E O R G I A, Rabun COUNTY
Under and by virtue of the power of sale contained in a Deed to Secure Debt given by ELIZABETH EPPERSON to RABUN COUNTY BANK dated November 14, 2008, and recorded in Deed Book I-34, Pages 312-314, Rabun County, Georgia Records, conveying the after described property to secure a note dated March 14, 2014 in the original principal amount of FIFTY SIX THOUSAND SIX HUNDRED THIRTY SEVEN AND 52/100 DOLLARS ($56,637.52), with interest thereon as set forth therein, there will be sold by the undersigned at public outcry to the highest bidder, for cash, before the courthouse door of Rabun County, Georgia, within the legal hours of sale on the first Tuesday in August, 2015, the same being August 4, 2015, the following described property:
All that tract or parcel of land lying and being in Land Lot 70 of the Second Land District of Rabun County, Georgia and being TRACT 3, consisting of 1.25 acres more or less, and more particularly described upon that certain plat of survey dated July 27, 1999, by William F. Rolader, Georgia Registered Land Surveyor No. 2042, said survey being recorded in Plat Book 45, Page104, Clerks office, Rabun Superior Court, reference to said plat being for the express purpose of incorporating its description.
There is also conveyed herewith those certain easement rights as described in that certain easement from Donald H. Justus and Erma Justus to Chris L. Justus dated September 18, 2004, and recorded in the office of the Clerk of Rabun Superior Court in Deed Book Z-26, Page 89.
Also conveyed is the 2002 Mirage Mobile Home, VIN H177222GLR, which is located on the subject property.
The debt secured by said deed to secure debt has been and is hereby declared due because of, among other possible events of default, the failure to pay the indebtedness as and when due and in the manner provided in the Note and Deed to Secure Debt. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the Deed to Secure Debt and by law, including attorney's fees (notice of intent to collect attorney's fees having been given).
Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which may be disclosed by a current accurate survey and inspection of the property, any easements, assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Deed to Secure Debt first set out above. The entity that has full authority to negotiate, amend and modify all terms of the Deed to Secure Debt with the Debtor is: RABUN COUNTY BANK located at 121 Rickman Street, Clayton, Georgia 30525, 706-782-4571. The secured Creditor is not required by law to negotiate, amend or modify the terms of the Deed to Secure Debt.
To the best knowledge and belief of the undersigned the parties in possession of the property are ELIZABETH EPPERSON and CHRIS L. JUSTUS and/or any tenant or tenants in possession and said property is located at Tract 3, off of Lasso Lane, Clayton, Georgia 30525 and is designated as being Rabun County Tax Parcel #031C-037C. The sale will be conducted subject to: (1.) confirmation that the sale is not prohibited under the U. S. Bankruptcy Code; and (2.) final confirmation and audit of the status of the loan with the holder of the Deed to Secure Debt.
