NOTICE OF SALE UNDER POWER
By virtue of a lien and a power of sale contained in the amended Declaration of Covenants, Conditions and Restrictions of Brassie Knob Villas Homeowners Association, Inc. of file and record in Deed Book E-7, Pages 371-383-A and Deed Book L-34, Pages 568-570 in the Office of the Clerk of Rabun County Superior Court, and said amended Declaration providing for the assessment, payment and collection of certain maintenance fees and other charges due said Brassie Knob Homeowners Association, Inc. by the following owners with late charges and interest, and said charges to the following being past due and unpaid, demand by certified mail having been made upon them by the said Association, and payment refused, there will be sold by the undersigned at public outcry to the highest bidder, for cash before the Courthouse door in Rabun County, Georgia, within the legal hours of sale on the first Tuesday in August, 2015, the same being August 4, 2015, the following described property of the named owners:
Certain Interval Time Share Unit Weeks and all rights, title and interest pertaining thereto in Brassie Knob Villas Homeowners Association, Inc. and the improved property located in the 2nd Land District, Land Lot 170 of Rabun County, Georgia known as Brassie Knob Villas Condominiums as is more fully shown on plats of same recorded in Plat Book 15, Page 212 and Plat Book 16, Page 3, in said Clerks Office owned by: Gene and Ann Carney, 2720 SE Loop 16th Street, Ocala, Florida 34417; James A. Faller, 126 Lakeshore Drive, Apt. 526, N. Palm Beach, Florida 33408; Everett Fuller, 907 Muirfield Place, New Bern, North Carolina 28560; David W. Hawk, 1421 Elizabeth Avenue, Perry, Georgia 31069; W.D. Huiet, 1005 N. Main Street, Anderson, South Carolina 29621; Reverend John M. Hunt, 6141 Ascot Way, Columbus, Georgia 31909; Daniel Muchaluk, 4000 Creekside Drive, Suite 801, Dundas Ontario, Canada L9H759; Frank A. Siragusa, 69-30 61st Drive, Middle Village, New York 11374; Nancy Turner, 205 Blanca Avenue, Tampa, Florida 33606; Nathan Vickers, 113 San Marino Drive, San Rafael, California 94901; John C. Yowell, 2220 Cypress Creek Road, Land O Lakes, Florida 34639; William H. Bowins, 15065 SE 73rd Avenue, Summerfield, Florida 34491.
The said indebtedness has been and is hereby declared in default by reason of non-payment of said charges and assessments. The debts remaining in default, this sale will be made for the purpose of satisfying the same and all expenses of this sale, including attorney's fees.
Said property will be sold as the property of the named debtors subject to any and all ad valorem taxes, the right of redemption of any taxing authority, any matters which might be disclosed by a current and accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, security instruments and any other matters of record superior to the indebtedness described herein.
The sale will be conducted subject to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code.
The undersigned will execute a Deed Under Power of Sale to the purchaser at said sale.
