Pursuant to O.C.G.A. 44-3-232(c) of the Georgia Property Owners Act and the Writ of Fieri Facias entered by the Superior Court of Gwinnett County, Georgia on November 5, 2014; Civil Action No. 13-A-07407-3 and in favor of Dover Place Condominium Association, Inc. plaintiff and against Monique Smith, defendant, the below described property will be sold at public auction to the highest and best bidder for cash, between the legal hours of sale before the courthouse doors in Gwinnett County, Georgia, on the first Tuesday in August, 2015 to wit: August 4, 2015.
ALL THAT TRACT OR PARCEL OF LAND LYING AND BEING IN LAND LOT 173 OF THE 6TH DISTRICT OF GWINNETT COUNTY, GEORGIA, AND BEING IDENTIFIED AND DEPICTED AS CONDOMINIUM UNIT NO. 814, BUILDING NO. 61 OF DOVER PLACE CONDOMINIUM ON THAT CERTAIN PLAT RECORDED IN CONDOMINIUM PLAT BOOK 1, PAGE 294, ET SEQ., GWINNETT COUNTY, GEORGIA RECORDS, TOGETHER WITH ITS APPURTENANT PERCENTAGE OF UNDIVIDED INTEREST IN THE COMMON ELEMENTS OF SAID DOVER PLACE CONDOMINIUM, A CONDOMINIUM, AS PROVIDED IN THAT CERTAIN DECLARATION FOR DOVER PLACE CONDOMINIUM, A CONDOMINIUM, RECORDED IN DEED BOOK 2678, PAGES 1-35, GWINNETT COUNTY, GEORGIA RECORDS, OR AS HEREAFTER AMENDED AS THEREIN PROVIDED. THE DESCRIPTION ALSO INCLUDES THE DECLARATION RECORDED AT DEED BOOK 5568, PAGE 162, GWINNETT COUNTY, GEORGIA RECORDS OF AS HEREAFTER AMENDED AS THEREIN PROVIDED.
Said property having been found to be in the possession of the defendant, Georgette Pound and levied upon as the property of the defendant in accordance with the Writ of Fieri Facias stated above.
The sale will be held subject to any unpaid taxes, assessments, rights-of-way, easements, protective covenants or restrictions, liens, and other superior matters of record, which may affect said property.
The sale will be conducted subject to confirmation that the sale is not prohibited under the United States Bankruptcy Code.
