NOTICE OF SALE UNDER POWER GEORGIA, GLYNN COUNTY THIS IS AN ATTEMPT TO COLLECT A DEBT. ANY INFORMATION OBTAINED WILL BE USED FOR THAT PURPOSE. Under and by virtue of the Power of Sale contained in a Security Deed given by Mark A Popwell and Bethany M. Wiggins to Mortgage Electronic Registration Systems, Inc., as nominee for Sunshine Mortgage Corporation, its successors and assigns, dated April 14, 2005, recorded in Deed Book 1653, Page 305, Glynn County, Georgia Records, as last transferred to The Bank of New York Mellon, f/k/a The Bank of New York, successor in interest to JPMorgan Chase Bank, N.A. as Trustee for Structured Asset Mortgage Investments II Inc., Bear Stearns ALT-A Trust 2005-7, Mortgage Pass-Through Certificates, Series 2005-7 by assignment recorded in Deed Book 2975, Page 411, Glynn County, Georgia Records, conveying the after-described property to secure a Note in the original principal amount of ONE HUNDRED THIRTY THOUSAND EIGHT HUNDRED AND 0/100 DOLLARS ($130,800.00), with interest thereon as set forth therein, there will be sold at public outcry to the highest bidder for cash before the courthouse door of Glynn County, Georgia, or at such place as may be lawfully designated as an alternative, within the legal hours of sale on the first Tuesday in August, 2015, the following described property: SEE EXHIBIT "A" ATTACHED HERETO AND MADE A PART HEREOF The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in Security Deed and by law, including attorney's fees (notice of intent to collect attorney's fees having been given). Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above. Conine, Georgia Registered Land Surveyor No. 1545, of record in the office of the Clerk of the Superior Court of Glynn County, Georgia, in Plat Drawer 19, Map No. 988, and as further described according to the Declaration of Brockinton South Condominiums dated the 6th day of September, 1984, and recorded in said Clerk's office in Deed Book 25-G, beginning at Page 210, and to the plans and specifications of Brockinton South Condominiums, prepared by G. David Newton, Georgia Registered Architect No. 1199, of record in said Clerk's Office in Condominium Book 4, Page 717. The Unit contains an undivided percentage interest in and to the common elements of Brockinton South Condominiums (as such common areas are defined in said Declaration), together with all of the right, title and interest of the Grantor in and to said Unit and the appurtenances thereunto under said Declaration. The above-described plat, plans and Declaration, and any recorded amendments thereto, are incorporated herein by reference and made a part hereof for all further purposes of description and identification and for all other purposes. This conveyance is made subject to the terms, provisions and restriction contained in the Georgia Condominium Act, as amended from time to time, and in the said Declaration. By acceptance of this deed, Grantee acknowledges receipt of a copy of said Declaration and covenants and agrees to comply with all of the terms, provisions and restrictions set forth therein, as amended from time to time.
