NOTICE OF SALE UNDER POWER
Under and by virtue of the power of sale contained in a Security Deed from LEWIS S. POOLEY to UNITED COMMUNITY BANK, dated January 6, 2014, recorded February 28, 2014, in Deed Book S40, Page 98, Rabun County, Georgia records, said Security Deed being given to secure a Note from LEWIS POOLEY dated February 11, 2013, in the original principal amount of Sixty Thousand Two Hundred Twenty Nine and 50/100 ($60,229.50) Dollars, with interest from date at a rate per cent per annum on the unpaid balance until paid; there will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door at Rabun County, Georgia, within the legal hours of sale on the first Tuesday in July, 2015, the following described property:
The following described property in the County of Rabun, in the State of Georgia.
All that tract or parcel of land lying and being in Land Lot 26 of the Fourth Land District of Rabun County, Georgia, and being designated as Lot 8, Phase 4 of Rainey Mountain Acres, containing 1.32 acres and being more fully described on a plat of survey prepared by William F. Rolader, Georgia Registered Land Surveyor No. 2042, dated July 15, 1991, which is recorded in the Office of the Clerk of Rabun Superior Court in Plat Book 30, Page 202. Reference is had and made to said plat and record of the same for a full and complete description of the property herein conveyed.
This conveyance is made subject to those certain Restrictive Covenants which are recorded in the Office of the Clerk of Rabun Superior Court in Deed Book V-10, Page 370.
This conveyance is made subject to that certain Road Affidavit which is recorded in the Office of the Clerk of Rabun Superior Court in Deed Book V-10, Page 372.
There is also conveyed herewith a perpetual non-exclusive easement for ingress and egress to and from the above-described property across Mountain Road as shown upon the above-referenced plat of survey in order to provide access to the above-described property from She Creek Road.
The Grantees, by the recording of this instrument, do hereby agree to the joint maintenance of the roadways and water system within the boundaries of Rainey Mountain Acres with the maintenance of same to be administered by a Property Owners Association comprised of all lot owners of Phase Four, Rainey Mountain Acres. Grantees shall have the right to tap onto the water system serving Phase F`our of Rainey Mountain Acres.
Subject to Restrictions, Reservations, Easements, Covenants, Oil, Gas or Mineral Rights of record, if any.
The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the Security Deed and by law, including attorney's fees (notice of intent to collect attorney's fees having been given).
Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, easements, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
To the best knowledge and belief of the undersigned, the party in possession of the property is LEWIS S. POOLEY or a tenant or tenants. UNITED COMMUNITY BANK, as attorney in Fact for LEWIS S. POOLEY
