NOTICE OF SALE UNDER POWER GEORGIA, GILMER COUNTY By virtue of a Power of Sale contained in that certain Security Deed from Charles Oakley and Amanda Pinson a/k/a Amanda Pinion to Branch Banking and Trust Company, dated February 23, 2006, recorded February 27, 2006, in Deed Book 1237, Page 255, Gilmer County, Georgia Records, and as modified, said Security Deed having been given to secure a Note of even date in the principal amount of ONE HUNDRED THIRTY-FIVE THOUSAND DOLLARS AND NO CENTS ($135,000.00), with interest thereon as provided for therein, there will be sold at public outcry to the highest bidder for cash before the courthouse door of Gilmer County, Georgia, within the legal hours of sale on the first Tuesday in July 2015 by Branch Banking and Trust Company, as Attorney in Fact for Charles Oakley and Amanda Pinson a/k/a Amanda Pinion, a/k/a Amanda Oakley, all property described in said Security Deed including but not limited to the following described property: ALL THAT TRACT OR PARCEL OF LAND LYING AND BEING IN LAND LOT 269 OF THE 25TH DISTRICT AND 2ND SECTION OF GILMER COUNTY, GEORGIA, DESIGNATED AS LOT 176 OF TRANQUILITY AT CARTERS LAKE SUBDIVISION, PHASE 3 AND CONSISTING OF 1.26 ACRES, AS SHOWN ON A PLAT OF SURVEY FOR TRANQUILITY AT CARTERS LAKE. SAID PLAT, DATED OCTOBER 15, 2004 BY MARK E. CHASTAIN, GEORGIA REGISTERED LAND SURVEYOR NO. 2718, IS RECORDED IN PLAT BOOK 44, PAGE 189, GILMER COUNTY, GEORGIA RECORDS, WITH REFERENCE MADE THERETO FOR THE PURPOSE OF INCORPORATING SAME. CONVEYANCE OF THE ABOVE PARCELS IS MADE SUBJECT TO AND BENEFITTED BY THE FOLLOWING: (1) THE DECLARATION OF COVENANTS, RESTRICTIONS, EASEMENTS FOR TRANQUILITY AT CARTERS LAKE AS SET OUT IN A DOCUMENT RECORDED IN DEED BOOK 1009, PAGE 421, GILMER COUNTY, GEORGIA RECORDS, AND AS AMENDED. (2) ALL EASEMENTS AND RIGHT-OF-WAYS AS SHOWN ON PLAT OF SURVEY FOR TRANQUILITY AT CARTERS LAKE AS RECORDED IN PLAT BOOK 41, PAGE 187, GILMER COUNTY RECORDS. THE ABOVE DESCRIBED TRACT IS A PORTION OF THE SAME PROPERTY WHICH WAS CONBEYED BY WARRANTY DEED FROM PFISTER INVESTEMENT (GEORGIA) INC. TO DOVER-PFISTER, LLC, DATED JANAURY 18, 2003 AND RECORDED IN DEED BOOK 923, PAGE 392, GILMER COUNTY RECORDS. The indebtedness secured by said Security Deed has been and is hereby declared due because of default under the terms of said Security Deed and Note, including but not limited to the nonpayment of the indebtedness as and when due. The indebtedness remaining in default, this sale will be made for the purpose of paying the same, all expenses of the sale, including attorneys' fees and all other payments provided for under the terms of the Security Deed and Note. Said property will be sold subject to the following items which may affect the title to said property: any superior Security Deeds of record; all zoning ordinances; matters which would be disclosed by an accurate survey or by an inspection of the property; any outstanding taxes, including but not limited to ad valorem taxes, which constitute liens upon said property; special assessments; all outstanding bills for public utilities which constitute liens upon said property; all restrictive covenants, easements, rights-of-way and any other matters of record superior to said Security Deed.
