NOTICE OF SALE UNDER POWER IN DEED TO SECURE DEBT
By virtue of the Power of Sale contained in a Deed to Secure Debt dated January 27, 2004, from Domingo Landaverde to Tony L. Segars, Angela F. Segars, Randy C. Segars, Laura C. Segars, and recorded in Deed Book 1025, page 416, Gilmer County Records; said Deed to Secure Debt being given to secure a promissory note of even date, in the original principal amount of $28,000.00, with interest from date as stated therein; the holder thereof, KIKER FARMS & LAND, LLC, transferee by instrument recorded in Deed Book 1914, page 512, Gilmer County Records, will offer the property described below for sale at public outcry to the highest bidder for cash before the courthouse door at Gilmer County, Georgia, within the legal hours of sale on the first Tuesday in July, 2015. The property is described as follows:
All that tract or parcel of land lying in Land Lot 152 of the 11th District, 2nd Section, Gilmer County, Georgia, containing .76 acres and designated as Lot 13 of Victoria Springs, Phase II, as shown on plat of survey prepared by Joel Jordan, RLS 2430, dated October 1994, recorded in Plat Book 24, page 225, Gilmer County Records; to which reference is made for a complete and accurate legal description; together with all improvements, fixtures, shrubbery, including a mobile home and appurtenances thereto.
TOGETHER WITH that certain housing unit which was formerly personalty, but is now permanently annexed and affixed to the above-described land as a permanent improvement and which is a 1995 double wide manufactured home bearing Serial # GMHGA31395608AB D-1336, and HUD # GEO/847298 and 847299.
This conveyance is subject to the Declaration and Covenants, Conditions and Restrictions recorded in Deed Book 428, Page 80, Gilmer County, Georgia Records.
Together with non-exclusive right to water from a pump located on adjacent land, together with rights to maintain and repair said pump and the pipes and other appurtenances thereto. Payment of expenses of maintenance and repair of said well shall be as set forth in prior deed.
The debt secured by said Deed to Secure Debt has been and is hereby declared due because of, among other possible events of default, non-payment of the monthly installments on said loan. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale including attorney's fees.
To the best information, knowledge and belief of the undersigned, the property is presently in the possession of Domingo Landaverde.
The property will be sold as the property of said Domingo Landaverde, and will be sold subject to all restrictions, liens, encumbrances, easements and other matters of record, if any, to which the Deed to Secure Debt is junior and inferior in terms of priority, and subject to any and all unpaid taxes or assessments relating to the property.
