gpn 11 NOTICE OF SALE UNDER POWER STATE OF GEORGIA COUNTY OF DODGE Under and by virtue of the power of sale (the Power of Sale) contained in that certain Deed to Secure Debt given by CHAD ALLEN EVANS to AGGEORGIA FARM CREDIT, ACA, as agent/nominee, dated September 14, 2007, recorded in Deed Book 585, Page 318, Clerks Office, Dodge Superior Court (the Security Deed) conveying the after-described property to secure that certain Promissory Note (the Note) executed by Chad Allen Evans in favor of AgGeorgia Farm Credit, ACA, as agent/nominee, dated September 14, 2007 in the original principal amount of Sixty Eight Thousand and 00/100 Dollars ($68,000.00), with interest thereon as set forth therein, there will be a sale at public outcry to the highest bidder for cash before the courthouse door of Dodge County, Georgia, within the legal hours of sale on the first Tuesday of July 2015, the following described property (the Property): TRACT I: ALL THAT CERTAIN PROPERTY SITUATED AND BEING IN THE COUNTY OF DODGE, STATE OF GEORGIA, IN LOT NO. 109 OF THE 19TH LAND DISTRICT MORE PARTICULARLY DESCRIBED AS FOLLOWS: BEGINNING AT A POINT ON THE SOUTHWEST LINE OF SAID LOT, SAID POINT OF BEGINNING BEING 558 FEET SOUTHEAST OF THE WEST CORNER OF SAID LAND LOT, AND BEING THE CENTER LINE OF A COUNTY ROAD KNOWN AS THE OLD COCHRAN CHESTER ROAD; THENCE RUN NORTH 44 DEGREES EAST A DISTANCE OF 210 FEET TO A POINT; THENCE RUN SOUTH 45 DEGREES EAST A DISTANCE OF 210 FEET TO A POINT; THENCE RUN SOUTH 44 DEGREES WEST A DISTANCE OF 210 FEET TO A POINT ON THE SOUTHWEST LOT LINE OF SAID COUNTY LAND LOT AND THE CENTER LINE OF SAID COUNTY LINE; AND THENCE RUN NORTH 45 DEGREES WEST ALONG THE SOUTHWEST LOT LINE AND THE CENTER LINE OF SAID COUNTY ROAD A DISTANCE OF 210 FEET TO THE POINT OF BEGINNING. SAID LOT CONTAINING A BRICK DWELLING HOUSE THEREON ALL ACCORDING TO A PLAT OF SURVEY MADE BY HARRELL AND ROSS SURVEYORS ON JULY 18, 1961, REFERENCE BEING MADE TO SAID PLAT IN AID OF THIS DESCRIPTION. SAID PLAT RECORDED IN PLAT BOOK NO. 4, PAGE 209, IN THE OFFICE OF THE CLERK OF DODGE COUNTY, GEORGIA, SUPERIOR COURT. TRACT II: ALL THAT TRACT OR PARCEL OF LAND LYING AND BEING IN LAND LOTS NOS. 132 AND 133 IN THE 19TH LAND DISTRICT OF DODGE COUNTY, GEORGIA, CONSISTING OF 4.78 ACRES, MORE OR LESS, AND BEING MORE PARTICULARLY DESCRIBED ACCORDING TO A PLAT OF SURVEY PREPARED BY RONNY BARRON, GEORGIA REGISTERED LAND SURVEYOR NO. 2532, DATED JUNE 30, 2007 AND RECORDED IN THE OFFICE OF THE CLERK OF DODGE SUPERIOR COURT IN PLAT BOOK 36, PAGE 144, SAID PLAT AND THE RECORDING THEREOF BEING INCORPORATED HEREIN AND MADE A PART HEREOF BY REFERENCE FOR DESCRIPTIVE AND ALL OTHER LEGAL PURPOSES. The debts secured by said Security Deed have been and are hereby declared due as a result of failure to observe the requirements of the terms of the Note and Security Deed. The debts remaining in default, this sale will be made for the purpose of paying same and, additionally, all expenses of this sale, as provided in the Security deed and by law, including without limitation attorney fees (the statutory notice of intent to collect attorney fees having been served).Said Property will be sold subject to any outstanding ad valorem taxes (including taxes that are a lien, but not yet due and payable); matters that may be disclosed by an accurate survey and/or inspection of the property; assessments, liens, encumbrances, zoning ordinances, restrictions, covenants; and matters of record superior to the Security Deed.
