gpn 11 LEGAL NOTICE OF SALE UNDER POWER GEORGIA, DODGE COUNTY By Virtue of the Power of Sale contained in the Deed to Secure Debt executed on June 20, 2012, by JOANN WHITE of Telfair County, Georgia, to THE BANK OF LUMBER CITY, a banking institution with offices in Lumber City, Telfair County, Georgia, said Security Deed filed for record on June 21, 2012, and recorded in Deed Book #709 Folio #113-120 in the Office of the Clerk of Superior Court of Dodge County, Georgia, there will be sold at public auction before the Courthouse door in Dodge County, Georgia, to the highest bidder for cash, by THE BANK OF LUMBER CITY, as attorney in fact for the said JOANN WHITE, within the legal hours of sale on July 7, 2015, the first Tuesday in July, the following described property, to-wit: ALL THAT TRACT OR PARCEL OF LAND LYING AND BEING IN THE CITY OF CHAUNCEY, DODGE COUNTY, GEORGIA, BEING A PORTION OF BLOCK H OF THE EASTVIEW SURVEY/SUBDIVISION, CONTAINING .48 ACRE, MORE OR LESS, AND BEING MORE PARTICULARLY DESCRIBED IN THAT CERTAIN PLAT OF SURVEY BY FREDDIE J. HATTAWAY, GRLS NO. 2467, SOUTHERN SURVEYING ASSOCIATES, DATED MAY 17, 2012, RECORDED IN PLAT BOOK 38, PAGE 229, IN THE OFFICE OF THE CLERK OF SUPERIOR COURT FOR DODGE COUNTY, GEORGIA. THIS IS A PORTION OF THE PROPERTY DESCRIBED IN A DEED FROM KATHY LOWE TO RUSSELL YAWN AND MARIE YAWN DATED SEPTEMBER 18, 1975, RECORDED IN DEED BOOK 141, PAGES 2-3 IN THE OFFICE OF THE CLERK OF SUPERIOR COURT FOR DODGE COUNTY, GEORGIA. [AKA 5059 HWY 341, CHAUNCEY, GA. 31011; AND TAX PARCEL 052-058C] The above-described Security Deed was given to secure that certain Promissory Note from Joann White to the Bank of Lumber City dated June 20, 2012, in the original principal amount of TWENTY-NINE THOUSAND, FIVE HUNDRED AND THIRTY SIX DOLLARS AND 00/100 $29,536.00 Dollars, with interest as specified in said Note, said original Note having been executed and delivered to the said BANK OF LUMBER CITY, same having been due and payable in 35 regular payments beginning on the 26th day of July, 2012, and continuing on the 26th day of every month thereafter with a final irregular payment of all outstanding principal and interest due on June 26, 2015, and further securing any renewals of said note. Said Note, or renewal note, is currently past due or in default and the Security Deed securing same provides that in case of any default in the performance of any of the covenants or agreements or of any payment that the holder may declare the entire indebtedness due and payable at once. The debt secured by the above-described Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay in accordance with the terms of said Note. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, including attorneys fees as provided in said Note. Said property will be sold subject to any outstanding tax liens, ad valorem taxes and/or assessments, if any, and subject to all easements of record, and is now in the possession of JOANN WHITE or JASON WEBSTER to the best knowledge of Holder. Notice has been given and is hereby given of intention to enforce provisions for collection of attorneys fees and costs of foreclosure in accordance with the legal requirements and the terms of said Note and Deed to Secure Debt. The above-described property will be sold to the highest bidder for cash and the proceeds will be applied to said indebtedness, attorneys fees as specified in said Note, and the lawful expenses of said sale, all as provided in said Security Deed, and a conveyance will be made to the purchaser at the sale as authorized by said Security Deed.
