gpn11NOTICE OF SALE UNDER POWER CONTAINED INDEED TO SECURE DEBTSTATE OF GEORGIA.COUNTY OF CRISP.WHEREAS, heretofore, Phoenix Petroleum, LLC did on the 18th day of December, 2009, execute to the Bank of Terrell a Deed to Secure Debt as to a tract which has been duly recorded in Deed Book 843, page 189, of the public deed records of Crisp County, Georgia.AND WHEREAS, said Security Deed conveyed to Bank of Terrell the real estate hereinafter described as security for the indebtedness from the said Phoenix Petroleum, LLC to the Bank of Terrell, including one (1) Promissory Note.AND WHEREAS, the said indebtedness has not been paid, when due, and is now in default, and the undersigned Bank of Terrell has elected to accelerate the debts and has declared the same to be in default and immediately due and payable;AND WHEREAS, under and by virtue of the terms of said Deed to Secure Debt and the power of sale therein described, there will be sold by the undersigned at public outcry to the highest and best bidder for cash, before the courthouse door in Crisp County, Georgia, within the legal hours of sale, on the first Tuesday in July, 2015, the following described property, to wit:A tract of land lying and being in Land Lots 44 and 45 of the 11th Land District of Crisp County, Georgia, containing 3.016 acres more particularly depicted as Lot 1 according to a plat of survey of The Commons, prepared by Jason B. Faircloth, Georgia Registered Surveyor 2981, dated September 18, 2006 and recorded in plat slide 73-A in the office of the Clerk of Superior Court of Crisp County, Georgia. That plat is incorporated into this description for the purpose of a more complete description.The above described property is given a street address of 2302 GA Highway 300 Ext., Cordele, Georgia, according to the present street numbering system.The above described property will be sold as the property of Phoenix Petroleum, LLC, and will be sold subject to the following items which may effect title to said property: All zoning ordinances, matters which would be disclosed by an accurate survey or an inspection of the property, all outstanding taxes, including but not limited to ad valorem taxes or assessments which may constitute liens upon said property; and all prior easements, restrictions, rights of way, and prior encumbrances of record, including but not limited to,Right of Way Deed in favor of the Georgia Department of Transportation, dated December 23, 1980, recorded in deed book 147, page 436, of the public deed records of Crisp County, Georgia.Right of Way Deed in favor of the Georgia Department of Transportation, dated December 23, 1982, recorded in deed book 147, page 446, of the public deed records of Crisp County, Georgia.Restrictions as shown in deed from Stone Mountain Industrial Park, Inc. to Carrot Top Properties, LLC, dated June 26, 2006, recorded in deed book 716, page 220, of the public deed records of Crisp County, Georgia.To the best knowledge and belief of the undersigned, the party presently in possession of said property is Phoenix Petroleum, LLC, and/or a tenant or tenants.Pursuant to O.C.G.A. 44-14-162.2, the person who shall have full authority to negotiate, amend and modify all terms of the mortgage with the debtor is as follows: Scott Beeley, P.O. Provided however, such person shall not be required to negotiate, amend, or modify the terms of a mortgage instrument.The indebtedness hereinabove described has been and is remaining in default.
