NOTICE OF SALE UNDER POWER STATE OF GEORGIA COUNTY OF COLUMBIA Under and by virtue of the power of sale contained with that certain Security Deed dated January 14, 2011, from John Paul Burnette, Jr. to Mortgage Electronic Registration Systems, Inc., as nominee for First Bank Mortgage A division of First Bank Of Georgia, recorded on January 18, 2011 in Deed Book 7687 at Page 77, Columbia County, Georgia Records, having been last sold, assigned, transferred and conveyed to Bank Of America, N.A. by Assignment and said Security Deed having been given to secure a note dated January 14, 2011, in the amount of $130,649.00, said note being in default, the undersigned will sell at public outcry during the legal hours of sale before the door of the courthouse of Columbia County, Georgia, on July 7, 2015, the following described real property (hereinafter referred to as the Property): ALL THAT LOT OR PARCEL OF LAND WITH IMPROVEMENTS THEREON, SITUATE, LYING AND BEING IN THE STATE OF GEORGIA, COUNTY OF COLUMBIA, BEING SHOWN AND DESIGNATED AS LOT 24, BLOCK B, SECTION II, SAINT ANDREWS SUBDIVISION, AS SHOWN ON A PLAT RECORDED IN THE OFFICE OF THE CLERK OF THE SUPERIOR COURT OF COLUMBIA COUNTY, GEORGIA, IN PC-A, SLIDE 189 #4; REFERENCE BEING MADE TO SAID PLAT FOR A MORE COMPLETE AND ACCURATE DESCRIPTION AS TO THE METES, BOUNDS AND LOCATION OF SAID PROPERTY. SAID PROPERTY IS CONVEYED SUBJECT TO AND WITH NOTICE OF THE FOLLOWING MATTERS: A) DRAINAGE EASEMENTS, BUILDING SETBACK LINES, AND ALL OTHER MATTERS SHOWN ON THE PLAT OF RECORD; B) GENERAL UTILITY EASEMENTS AND ROAD RIGHT-OF-WAY GRANTS AND EASEMENTS. SAID PROPERTY IS HEREBY CONVEYED SUBJECT TO PROTECTIVE COVENANTS RECORDED IN THE AFORESAID CLERK'S OFFICE IN DEED BOOK 459, PAGES 312-319 AND TO AN ENCROACHMENT AGREEMENT RECORDED IN THE AFORESAID CLERKS OFFICE IN DEED BOOK 591, PAGE 211 AND TO ANY AND ALL OTHER EASEMENTS AND RESTRICTIONS OF RECORD IN THE AFORESAID CLERKS OFFICE. TAX MAP and PARCEL NUMBER: 77E:277 SAID PROPERTY BEING COMMONLY KNOWN AS 4138 SAWGRASS COURT, EVANS, GEORGIA 30809. The debt secured by the Security Deed and evidenced by the Note and has been, and is hereby, declared due and payable because of, among other possible events of default, failure to make the payments as required by the terms of the Note. The debt remaining is in default and this sale will be made for the purposes of paying the Security Deed, accrued interest, and all expenses of the sale, including attorneys' fees. Notice of intention to collect attorneys' fees has been given as provided by law. To the best of the undersigned's knowledge, the person(s) in possession of the property is/are John Paul Burnette, Jr.. The property, being commonly known as 4138 SAWGRASS COURT, EVANS, GA 30809 in Columbia County, will be sold as the property of John Paul Burnette, Jr., subject to any outstanding ad valorem taxes (including taxes which are a lien and not yet due and payable), any matters affecting title to the property which would be disclosed by accurate survey and inspection thereof, and all assessments, liens, encumbrances, restrictions, covenants, and matters of record to the Security Deed.
