NOTICE OF SALE UNDER POWER Under and by virtue of the Power of Sale contained in a Security Deed from JOSEPH R. DOWELL, A Married Man, to Mortgage Electronic Registration Systems, Inc. as nominee for Mortgage Investors Corporation, dated December 28, 2009, and recorded on January 6, 2010, in DEED BOOK 7222, PAGE 291, of the Columbia County, Georgia Records, as last assigned to PLANET HOME LENDING, LLC (Secured Creditor), conveying the after-described property to secure a Note in the original principal amount of TWO HUNDRED THIRTY SEVEN THOUSAND Dollars and 00/100 ($237,000.00) with interest thereon as set forth therein, there will be sold at public outcry to the highest bidder for cash before the courthouse door of Columbia County, Georgia, within the legal hours of sale on the first TUESDAY in July, 2015, the following described property: ALL that lot or parcel of land with improvements thereon, situate, lying and being in the State of Georgia, County of Columbia, being shown and designated as Lot 5, Block A, Heritage Hill Subdivision, on a plat recorded in the Office of the Clerk of the Superior Court of Columbia County, Georgia, in PC-B, Slide 172, #1; reference being made to said plat for a more complete and accurate description as to the metes, bounds and location of said property. Said property is hereby conveyed subject Declaration of Covenants and Restrictions applicable to said subdivision of record in Deed Book 975, Pages BO-91 and also to any and all easements and restrictions of record in the aforesaid Clerk's Office. Tax map & parcel number: 078A 169 Said Property being commonly known as 3998 DOWLING DRIVE, MARTINEZ, GEORGIA 30907. The indebtedness secured by said Security Deed has been and is hereby declared due and payable because of, among other possible events of default, non-payment of the monthly installments as required by said Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the Security Deed and by law, including attorney's fees (notice of intent to collect attorney's fees having been given) and all other payments provided for under the terms of the Security Deed and Note. Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
