Emmer to Green Tree Financial Servicing Corporation n/k/a Green Tree Servicing LLC, dated September 26, 1997 and recorded in Deed Book 609, Page 631, in the Office of the Clerk of Superior Court of Catoosa County, Georgia, said Deed to Secure Debt having been given to secure a Note, dated September 24, 1997, in the original principal amount of Eighty Four Thousand Six Hundred Fifty Nine and 07/100 Dollars ($84,659.07) with interest thereon as provided therein, having been last sold, assigned and transferred to U.S. Bank N.A., as Trustee on behalf of Manufactured Housing Contract Senior/Subordinate Pass-Through Certificate Trust 1997-8, recorded in Deed Book 1709, Page 644, aforesaid records, will be sold at public outcry to the highest bidder for cash before the courthouse door of Catoosa County, Georgia, within the legal hours of sale on the first Tuesday of July 2015 regarding the following described property: All that tract or parcel of land lying and being in Original Land Lot Nos. One Hundred Eighty Three (183) and Two Hundred Fourteen (214) in the Eleventh (11th) District and Third (3rd) Section of Catoosa County, Georgia, and being Lot Fifty Nine (59) Equestrian Heights Subdivision, as shown by plat recorded in Plat Book 14, Page 180, in the Office of the Clerk of the Superior Court of Catoosa County, Georgia. Being a part of the same property conveyed to William R. Andrews and Charles B. Davis by Deed of Correction, from R. Wayne Peters and wife Faye C. Peters, dated September 21, 1994, recorded September 22, 1994, Book 500, Page 157, in the Office of the Clerk of the Superior Court for Catoosa County, Georgia. Also acquired by Deed of record in Book 499, Page 251. Said property is commonly known as 352 Saddle Horse Circle, Tunnel Hill, GA 30755. The indebtedness secured by said Deed to Secure Debt has been and is hereby declared due because of default under the terms of said Deed to Secure Debt and Note, including but not limited to the nonpayment of the indebtedness as and when due. The indebtedness remaining in default, this sale will be made for the purpose of paying the same, all expenses of the sale, including attorney's fees and all other payments provided for under the terms of the Deed to Secure Debt and Note. Said property will be sold subject to the following items which may affect the title of said property; zoning ordinances, matters which would be disclosed by an accurate survey or by an inspection of the property; any outstanding taxes, including but not limited to ad valorem taxes, which constitute liens upon said property; special assessments; all outstanding bills for public utilities which constitute liens upon said property; all restrictive covenants, easements, rights-of-way and any other matters of record superior to said Deed to Secure Debt.
