NOTICE OF SALE UNDER POWER GEORGIA, RICHMOND COUNTY Under and by virtue of the power of sale contained in a Deed to Secure Debt from Dearl W. Pearce to Askin Enterprises, Ltd. Co., A Georgia Corporation, dated July 18, 2013, recorded in Deed Book 1412, Pages 406-409, Richmond County, Georgia records. Said Deed to Secure Debt having been given to secure a note dated July 18, 2013, in the original principal sum of Thirty Nine Thousand Seven Hundred Twenty Five and 00/100 ($39,725.00) Dollars with interest from date at the rate stated in said note on the unpaid balance until paid, there will be sold by the undersigned at public outcry to the highest bidder for cash before the courthouse door at Richmond County, Georgia within the legal hours of sale on the first Tuesday in June, 2015, the property described in said Deed to Secure Debt, to wit: All that lot or parcel of land, situate, lying, and being in the 86th G.M.D., Richmond County, Georgia, containing 37.29 acres, more or less, and being known and designated as Tract B-9, Askin Acres Subdivision, as shown on a plat thereof prepared by George L. Godman & Associates, Reg. Land Surveyor, which plat is of record in the Office of the Superior Court Clerk for Richmond County, Georgia in Plat Bok 9, Page 32; reference being made to said plat for a more complete and accurate description of said property. Said property is commonly known as 2080 McNutt Road, Augusta, Georgia 30906. The debt secured by said Deed to Secure Debt has been and is hereby declared due because of, among other possible events of default, the non-payment of the monthly installments on said loan. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, including legal fees. This sale will be held subject to all unpaid taxes, assessments, and restrictions of record, if any, transfer tax and all state and county taxes. Said property will be sold as the property of Dearl W. Pearce, the property to the best information, knowledge, and belief of the undersigned, being presently in the possession of Dearl W. Pearce, and the proceeds of said sale will be applied to the payment of said indebtedness and all the expenses of said sale, including attorney's fees, all as provided in said deed, and the balance, if any, will be distributed as provided by law. Terms of the sale are to be cash, purchaser paying for papers, revenue stamps, and all state and county taxes. This 27th day of April, 2015. Dearl W.
