STATE OF GEORGIA COUNTY OF RICHMOND NOTICE OF SALE UNDER POWER IN DEED TO SECURE DEBT Under and by virtue of the power of sale contained in that certain Deed to Secure Debt from Clarence E. Frisby to CitiFinancial Services, Inc. in the original principal amount of $58,718.95 dated 04/26/2004, and recorded in Deed Book 924, page 1429, Richmond County records, said Security Deed being last transferred and assigned to CitiFinancial Servicing LLC in Deed Book 1445, page 2169, Richmond County records, the undersigned will sell at public outcry to the highest bidder for cash before the Courthouse door in said County, during the legal hours of sale, on the first Tuesday of June, 2015 by CitiFinancial Servicing LLC, as Attorney-in-Fact for Clarence E. Frisby the following described property: The land referred to in this exhibit is located in the County of Richmond and the State of Georgia in Deed Book 7 at Page 491 and described as follows: All that lot or parcel of land with improvements thereon, situate, lying and being in the City of Augusta, Richmond County, Georgia, having a frontage of 62 feet on the North side of Hopkins Street, between Twelfth (12th) and Harrison Streets, and extending back between slightly converging lines a distance of 78.6 feet on its eastern boundary and a distance of 79.6 feet on its western boundary, with a rear width of 60.6 feet, and being designated as Lot No. 2 on a plat of a survey made by J.E. Crouch, P.E. for a J. A. Lewis, on August 17th, 1971, which plat is recorded in the Office of the Clerk of the Superior Court of Richmond County, Georgia, in Realty Book 39-O, Page 347. Reference being hereby made to said plat for a more accurate description of the metes, bounds and location. Property known as: 1207 Hopkins St, Augusta, GA 30901 The indebtedness secured by said Deed to Secure Debt having been declared due and payable because of default in the payment of the indebtedness secured thereby, this sale will be made for the purposes of paying the same and all expenses of sale, including attorney's fees, (notice having been given as provided by law). The property will be sold as the property of Clarence E. Frisby and Estate of Clarence E. Frisby subject to the following: (1) all prior restrictive covenants, easements, rights-of-way or encumbrances; (2) all valid zoning ordinances; (3) matters which would be disclosed by an accurate survey of the property; (4) the outstanding ad valorem taxes and assessments, if any; (5) unpaid water and sewage bills, that constitute liens against the property, whether due and payable or not yet due and payable; and (6) matters of record superior to the security deed first set out above.
