NOTICE OF SALE UNDER POWER GEORGIA, HART COUNTY By virtue of a Power of Sale contained in a Security Deed (hereinafter, "Security Deed") from Eves J. Morvant to Southpoint Financial Services dated December 23, 2009, recorded January 12, 2010 in Deed Book 652, Page 101, Hart County, Georgia Records, as last transferred to Generation Mortgage Company by that certain Assignment recorded on February 12, 2010 in Deed Book 654, Page 71, a foresaid records, said Security Deed having been given to secure a Note of even date in the original principal amount of Two Hundred Seventy Seven Thousand Five Hundred and 00/100 Dollars ($277,500.00), with interest thereon as provided for therein. Said Security Deed will be sold at public outcry to the highest bidder for cash before the courthouse door of Hart County, Georgia, within the legal hours of sale on the first Tuesday in June, 2015, all property described in said Security Deed including, but not limited to, the following described property: ALL THAT TRACT OR PARCEL OF LAND WITH ALL IMPROVEMENTS THEREON LYING AND BEING IN THE 1114TH G.M. HART COUNTY, GEORGIA, CONTAINING TEN AND FOURTEEN ONE-HUNDREDTHS (10.14) ACRES, MORE OR LESS. AND BEING BOUNDED NOW OR FORMERLY SUBSTANTIALLY AS FOLLOWS: ON THE NORTHWEST BY GEORGIA HIGHWAY 77 SPUR; ON THE NORTHEAST BY PROPERTY OF HUBERT CHASTAIN; ON THE SOUTHEAST BY PROPERTY OF CATAWBA NEWSPRINT; AND ON THE SOUTHWEST BY PROPERTY OF COKESBURY METHODIST CHURCH; SAID TRACT BEING MORE PARTICULARLY DESCRIBED AS TO COURSES AND DISTANCES IN A SURVEY AND PLAT MADE BY A.M. BRITT, REGISTERED LAND SURVEYOR, DATED JANUARY 28, 1981, OF RECORD IN PLAT BOOK 23, AT PAGE 237, CLERK?S OFFICE, HART COUNTY, GEORGIA AND WHICH SURVEY, PLAT AND RECORDATION THEREOF ARE BY REFERENCE HEREBY INCORPORATED HEREIN IN AID OF THIS DESCRIPTION. THIS CONVEYANCE IS MADE SUBJECT TO A ROAD LEADING FROM GEORGIA HIGHWAY 77 SPUR TO COKESBURY METHODIST CHURCH AS SHOWN ON SAID SURVEY AND PLAT. LESS AND EXCEPT THAT PORTION OF THE PROPERTY CONVEYED TO THE COKESBURY UNITED METHODIST CHURCH OF HARTWELL, INC. ON 6/5/09 AND RECORDED 6/30/09 IN BOOK 638, PAGE 330. SUBJECT TO ANY EASEMENTS, RESTRICTIONS, RIGHTS OF WAYS OR RECORDS, IF ANY. Said property is more commonly known as 125 Cokesbury Church Road, Hartwell, GA 30643. The indebtedness secured by said Security Deed has been and is hereby declared due because of default under the terms of said Security Deed and Note, including but not limited to the nonpayment of the indebtedness as and when due. The indebtedness remaining in default, this sale will be made for the purpose of paying the same, all expenses of the sale, including attorneys' fees, and all other payments provided for under the terms of the Security Deed and Note. Said property will be sold on an as-is basis without any representation, warranty, or recourse against the above-named or the undersigned. Said property will be sold subject to the following items which may affect the title to said property: all zoning ordinances; matters which would be disclosed by an accurate survey or by an inspection of the property; any outstanding taxes, including but not limited to ad valorem taxes, which constitute liens upon said property; special assessments; all outstanding bills for public utilities which constitute liens upon said property; all restrictive covenants, easements, rights-of-way, and any other matters of record superior to said Security Deed. The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the Security Agreement.
