gpn11 NOTICE OF SALEUNDER POWER STATE OF GEORGIACOLQUITT COUNTY THIS LAW FIRM IS ATTEMPTING TO COLLECT A DEBT.ANY INFORMATION OBTAINED WILL BE USED FOR THAT PURPOSE. WHEREAS, on March 23, 2004, BRUCE BUCKLER executed and delivered unto BONANZA LAND COMPANY OF GEORGIA, INC., P. O Box 2355, Thomasville, GA 31799 a certain Installment Note and Deed to Secure Debt in order to secure the indebtedness therein recited, the original principal amount of said indebtedness being $44,600.00, and all other indebtedness then owing or thereafter arising between the parties, as shown by the record of same in Deed Book 815, page 462, among the Deed Records of Colquitt County, Georgia. The property subject to such Deed to Secure Debt was subsequently transferred to MATTHEW T. WEBB on March 7, 2012 by Warranty Deed recorded March 8, 2012 in Deed Book 1130, Page 262, Colquitt County Records and later to CHRISTOPHER FORRESTER by deed dated June 30, 2013 and recorded on June 3, 2013 in Deed Book 1175, Page 20, Colquitt County Records. Said buffer strip tract contains 1.10 acres. TRACT II: ALL THAT TRACT OR PARCEL OF LAND situate, lying and being in Land Lot, 8th Land District of Colquitt County, Georgia, and being 0.95 acres, more or less, of Land Lot 216, and more particularly shown on a plat of survey thereof prepared by Hurley J. Griffin, Surveyor, of date of October 11, 1989, and recorded in Plat Book 22, Page 76, in the Office of the Clerk of Superior Court of Colquitt County, Georgia, which plat by reference thereto is incorporated herein and made a part of this description. Also, the right of ingress and egress along the certain 50 foot access assessment from the west margin and Anderson Drive to the above described land shown on the plat identified above. The above described property is located in the Flood Plain established by the U.S. Department of Housing and Urban Development Federal Housing Administration and is indicated on the plat identified above. Said property is currently known as 319 Highway 319 North, Moultrie, Georgia 31768 according to the records of the Colquitt County Tax Assessor. WHEREAS, default has been made in the performance of the covenants and agreements secured by the above described security deed, and the present holder of record has elected to declare the entire remaining balance of the indebtedness secured by the aforesaid security deed due according to the terms of said security deed and the note secured thereby, NOW, THEREFORE, according to the original terms of said security deed pursuant to the power of sale contained therein and the laws in such cases made and provided, the undersigned will expose for sale to the highest and best bidder for cash the above described property, after proper advertisement, on the first Tuesday in June 2015, the same being June 2, 2015, between the legal hours of sale before the courthouse door in Moultrie, Colquitt County, Georgia. The proceeds from sale will be used for payment of that certain Deed to Secure Debt from BRUCE BUCKLER to BONANZA LAND COMPANY OF GEORGIA, INC. both principal and interest, insurance premiums, taxes, late charges and expenses, and attorneys fees for which proper notice has been given, and the balance, if any, delivered as provided by law. Said property will be sold subject to taxes for the year 2015 and any prior unpaid taxes, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants of matters of record superior to the security deed first set out above. The property described above shall be sold subject to any right of the United States of America to redeem the aforesaid property within 120 days of the above referenced foreclosure sale date to pay Federal Tax Liens.
