STATE OF GEORGIA COUNTY OF FANNIN NOTICE OF SALE UNDER POWER Under and by virtue of the power of sale contained in a Security Deed from CHERYL NAPOLITANO and RAYMOND G. COCKRELL to UNITED COMMUNITY BANK, dated June 10, 2005, recorded July 15, 2005, in Deed Book 653, Page 8, Fannin County, Georgia records, said Security Deed being given to secure a Note from CHERYL NAPOLITANO dated June 10, 2005, in the original principal amount of Eighty Thousand and 00/100 ($80,000.00) Dollars, with interest from date at a rate per cent per annum on the unpaid balance until paid; there will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door at Fannin County, Georgia, within the legal hours of sale on the first Tuesday in June, 2015, the following described property: All that tract or parcel of land lying and being in part of Land Lot Nos. 17 & 20 of the 9th District and 2nd Section of Fannin County, Georgia, and being Lot No. 74, containing 3.277 acres; and Lot No. 92, containing 1.322 acres of Hidden Valley Lakes Subdivision Phase II, as shown by Plat of Survey recorded in Plat Hanger A-491, Page 6, Fannin County Deed Records. Said survey is incorporated herein by reference for a more complete and accurate legal description of the above described property. This conveyance is made subject to those certain Easements and Rights of Way as shown on the aforementioned Plat. This conveyance is made subject to those certain Protective Covenants of record in Deed Book 266, Page 721, Fannin County Deed Records. This conveyance is subject to Hydrocarbon Interest as contained in that certain deed recorded in Deed Book 78, Page 303, Fannin County Deed Records. The above described property is the same property as that conveyed to Cheryl Napolitano and Raymond G. Cockrell by Warranty Deed dated June 15, 1999, from New Creation Land Company, Inc., recorded in Deed Book 327, Pages 235-36, Fannin County Deed Records. The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the Security Deed and by law, including attorney's fees (notice of intent to collect attorney's fees having been given). Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, easements, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above; including but not limited to that certain Security Deed from Cheryl Napolitano dated October 30, 2001, recorded in Deed Book 418, Page 4, Fannin County, Georgia records, as last assigned at Deed Book 784, Page 419, Fannin County, Georgia records. To the best knowledge and belief of the undersigned, the party in possession of the property is CHERYL NAPOLITANO and RAYMOND G. COCKRELL or a tenant or tenants.
