STATE OF GEORGIA COUNTY OF EMANUEL NOTICE OF SALE UNDER POWER IN DEED TO SECURE DEBT Under and by virtue of the power of sale contained in that certain Deed to Secure Debt from Shannon O. Brantley to Montgomery Bank & Trust in the original principal amount of $38,899.49 dated 03/01/2006, and recorded in Deed Book 263, page 630, Emanuel County records, said Security Deed being last transferred and assigned to Bayview Loan Servicing, LLC A Delaware Limited Liability Company in Deed Book 383, page 92, Emanuel County records, the undersigned will sell at public outcry to the highest bidder for cash before the Courthouse door in said County, during the legal hours of sale, on the first Tuesday of June, 2015 by Bayview Loan Servicing, LLC, a Delaware Limited Liability Company, as Attorney-in-Fact for Shannon O. Brantley the following described property: Tract Number One: All that tract or parcel of land, together with all improvements thereon, lying, situate, and being in the 395th G. M. District of Emanuel County, Georgia, containing 0.10 acre, more or less, and being designated as Tract "A", and being triangular in shape as shown on that certain plat of survey dated December 3, 1998, prepared by Charles M. Zeigler, Registered Surveyor, and recorded in Plat Book 18, Page 159, in the Office of the Clerk of Superior Court of Emanuel County, Georgia, which plat and record thereof is incorporated herein by reference and made a part of this deed and description. Said tract being bounded, now or formerly, as follows: North by the right-of-way of River Street; East by the right-of-way of US Hwy. No. 221 and State Route No. 56; South and West by land of Sharpe. Said property is the same as conveyed to Sean Evan Pope from Kathleen Pope, by warranty deed recorded on February 13, 2003, in Deed Book 197, Pages 261263, in the Office of the Clerk of the Superior Court of Emanuel County, Georgia. Tract Number Two: All that tract or parcel of land, together with all improvements thereon, lying, situate, and being in the 395th G. M. District of Emanuel County, Georgia, containing 5.16 acre, more or less, and being designated as Tract "B", as shown on that certain plat of survey dated December 3, 1998, prepared by Charles M. Zeigler, Registered Surveyor, and recorded in Plat Book 18, Page 159, in the Office of the Clerk of Superior Court of Emanuel County, Georgia, which plat and record thereof is incorporated herein by reference and made a part of this deed and description. Said tract being bounded, now or formerly, as follows: Northeast by the right-of-way of Johnson Street; East by the right-of-way of US Hwy. No. 221 and State Route No. 56; Southwest by the right-of-way of River Street; and Northwest by land of H.V. Horton. Said property is the same as conveyed to Sean Evan Pope from Kathleen Pope, by warranty deed recorded on February 13, 2003, in Deed Book 197, Pages 261-263, in the Office of the Clerk of the Superior Court of Emanuel County, Georgia. District of Emanuel County, Georgia, containing 0.20 acre, more or less, and being designated as Tract "D", and being triangular in shape as shown on that certain plat of survey dated December 3, 1998, prepared by Charles M. Zeigler, Registered Surveyor, and recorded in Plat Book 18, Page 159, in the Office of the Clerk of Superior Court of Emanuel County, Georgia, which plat and record thereof is incorporated herein by reference and made a part of this deed and description. Said tract being bounded, now or formerly, as follows: Northeast by land of Prysock; East by the right-of-way of US Hwy. No. 221 and State Route No. 56; and Southwest by the right-of-way of Johnson Street. Said property is the same as conveyed to Sean Evan Pope from Kathleen Pope, by warranty deed recorded on February 13, 2003, in Deed Book 197, Pages 261-263, in the Office of the Clerk of the Superior Court of Emanuel County, Georgia. Property known as: 311 Johnson Street aka 744 US Hwy 221 S, Adrian, GA 31002 The indebtedness secured by said Deed to Secure Debt having been declared due and payable because of default in the payment of the indebtedness secured thereby, this sale will be made for the purposes of paying the same and all expenses of sale, including attorney's fees, (notice having been given as provided by law). The property will be sold as the property of Shannon O. Brantley subject to the following: (1) all prior restrictive covenants, easements, rights-of-way or encumbrances; (2) all valid zoning ordinances; (3) matters which would be disclosed by an accurate survey of the property; (4) the outstanding ad valorem taxes and assessments, if any; (5) unpaid water and sewage bills, that constitute liens against the property, whether due and payable or not yet due and payable; and (6) matters of record superior to the security deed first set out above.
