NOTICE OF SALE UNDER POWER WHEREAS, on 11/27/89, for value received, Dianne H. Hudson executed and delivered to the United States of Ameri?ca, acting through the United States Department of Agriculture, a Deed to Secure Debt conveying certain real estate located in Emanuel County, Georgia, and said Deed to Secure Debt was record?ed in the Office of the Clerk of the Superior Court for Emanuel County, Georgia, in Book # 17, Page# 160; and WHEREAS, on 12/13/93, for value received, the subject loan was assumed by an Assumption Agreement, whereby the interest in this real property was conveyed to Larry Howell & Shelia G. Howell; and WHEREAS, on 12/13/93, for value received, Larry Howell & Shelia G. Howell executed and delivered to the United States of Ameri?ca, acting through the United States Department of Agriculture, a Deed to Secure Debt conveying certain real estate located in Emanuel County, Georgia, and said Deed to Secure Debt was record?ed in the Office of the Clerk of the Superior Court for Emanuel County, Georgia, in Book # 56, Page# 345; and re-recorded in Book # 59, Page# 31; and WHEREAS, the United States of America now holds the above described security deeds covering the said real estate; and WHEREAS, the Deeds to Secure Debt held by the United States of America provides that should default occur, the holder may declare the entire indebtedness secured by the Deeds to Secure Debt due and payable and, in compliance with the power of sale provisions contained in said security deeds proceed to sell the property at public outcry; and WHEREAS, after default, the United States of America has declared all of the indebtedness secured by the Deeds to Secure Debt due and payable and hereby certifies that it has complied with all of its loan servicing regulations; NOW, THEREFORE, the said United States of America, acting as aforesaid, under and in compliance with the power of sale provision contained in the Deeds to Secure Debt, will proceed to sell at public outcry, for cash or certified funds to the highest bidder in front of the Courthouse in Emanuel County, during the legal hours of sale, on the 2nd day of June, 2015, the following-described property conveyed in the Deeds to Secure Debt, to Wit:  All that lot or parcel of land lying and being in the City of Swainsboro, 53rd , G.M. District of Emanuel County, Georgia, being Lot Number Seven (7) in Block Lettered “N” of the Eastwood Estates Subdivision as shown on plat recorded in Plat Book 3, Page 11, in the Office of the Clerk of the Superior Court of Emanuel County, Georgia, and being more particularly shown on plat of survey made by Walter K. Maupin, Surveyor, dated November 3, 1977, recorded in Plat Book 8, Page 767, in aforesaid Clerk's Office and being more particularly described as follows:  BEGINNING for the same at a point on the southwest side of McLeod Drive, said point being measured north 17 degrees, 53 minutes west, 706.13 feet from the intersection of McLeod Drive and Colegrove Drive and running thence with the dividing line between said lot seven (7) and lot eight (8) south 72 degrees, 07 minutes west, 150 feet to a point, thence with the land of Frank M. Flanders north 17 degrees, 53 minutes west, 100 feet to a point; thence with the dividing line between said lot seven (7) and lot six (6) north 72 degrees, 07 minutes east, 150 feet to the southwest side of McLeod Drive, thence with the same south 17 degrees, 53 minutes east, 100 feet to the place of beginning. Per appraisal report dated 07/27/12 conducted by Hulsey-Johnston Inc., the subject property is believed to be in poor condition and is not considered to be habitable at this time. The above described property will be sold subject to any and all outstanding real estate taxes that are due and payable. The failure of any high bidder to pay the purchase price and close the sale shall, at the option of the United States of America, be cause for rejection of the bid, and, if the bid is rejected, the United States of America shall have the option of making the sale to the next highest bidder who is ready, willing and able to comply with the terms thereof.    The proceeds of said sale will first be applied to the payment of the indebtedness to the United States of America, other charges, and the expenses of sale, as provided in the above-described Deeds to Secure Debt.
