NOTICE OF SALE UNDER POWER
STATE OF GEORGIA
COUNTY OF CHATTOOGA
Because of default in the payment of the indebtedness secured by a Security Deed executed and delivered by James Burrage in favor of Vanderbilt Mortgage and Finance, Inc. dated August 11, 2004, in the original principal amount of $52,026.00, and recorded in Book 458, Page 641, Chattooga County, Georgia Records, the undersigned, Vanderbilt Mortgage and Finance, Inc., pursuant to the Security Deed and Note thereby secured, has declared the entire amount of said indebtedness due and payable and pursuant to the power of sale contained in the Security Deed, will on the first Tuesday in June, 2015, during the legal hours of sale, at the Courthouse door in Chattooga County, sell at public outcry to the highest bidder for cash, the property described in the Security Deed to-wit:
All that tract or parcel of land lying and being in the 13th District and 4th Section of Chattooga County, Georgia and in Land Lot Number 3, and in Blocks C and D of the Harlow Subdivision and more particularly described as follows:
Beginning at an iron pin which is the Southwest corner of property formerly belonging to James Burrage and now the property of Alvin Burrage, and running thence North 89 degrees 57 minutes 30 seconds East 208.22 feet to an iron pin; thence South 00 degrees 26 minutes 00 seconds East 65 feet to a point; thence North 89 degrees 57 minutes 30 seconds East 62 feet to a point; thence South 00 degrees 26 minutes 00 seconds East 615.41 feet to an axle found; thence South 80 degrees 49 minutes 50 seconds West to the Center of the Dalton (Battle) Creek; thence in a Northwesterly direction following the middle and the meanderings of said creek to a point adjacent to the beginning point and continuing therefrom the middle of said creek to the point of beginning. Containing 2 acres more or less.
Reference is made for Grantors source of interest in the property and to the legal description contained herein to Deed of record in Book 213, Page 604, in the Superior Court Clerks Office of Chattooga County, Georgia.
Subject to any governmental zoning and subdivision ordinances or regulations in effect thereon.
Subject to any covenants, conditions, reservations, restrictions, and easements of record.
which has the address of 173 Roberts Street, Summerville GA 30735; and the Chattooga County Tax Map Parcel ID Number 38-147.
Together with all fixtures and other personal property conveyed by the Security Deed.
The sale will be held subject to any unpaid taxes, assessments, rights-of-way, easements, protective covenants, restrictions, liens, and other superior matters of record which may affect said property.
The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the Security Deed.
Notice has been given of intention to collect attorneys fees in accordance with the terms of the note secured by the Security Deed. Notice has been also given, in writing and by certified mail return receipt requested, of the name, address, and telephone number of the individual or entity who shall have full authority to negotiate, amend, and modify all terms of the Security Deed and the note thereby secured in accordance with O.C.G.A. 44-14-162.2(a).
To the best knowledge and belief of the undersigned, the party in possession of the property is James Burrage, or tenant or tenants. The proceeds of said sale will be applied to the payment of said indebtedness and the expense of said sale, all as provided in the Security Deed. The undersigned will execute a deed to the purchaser as provided in the aforementioned Security Deed.
