IN THE SUPERIOR COURT FOR THE COUNTY OF COLQUITT STATE OF GEORGIA CIVIL ACTION FILE NO. PETITION FOR CONDEMNATION BOARD OF COMMISSIONERS OF COLQUITT COUNTY PLAINTIFF/CONDMENEE VS. 0.35 Acres of land; LANCE HUNT, LARRY ALLEN HUNT, JR., and RUTH GREENE, DEFENDANTS/CONDEMNEES CITATION The said LANCE HUNT, LARRY ALLEN HUNT, JR., RUTH GREENE, and any and all other persons, known and unknown, claiming any right, title, power, interest, ownership, equity, claim or demand in and to the land hereinafter described, and all occupants, tenants, lessees, licenses and all holders, owners and users of ways and easements in, across, over and under said land are hereby notified, under the provisions of Official Code of Georgia Sect. 32-3-1, providing for the exercise of the power of eminent domain by the Board of Commissioners of Colquitt County, Georgia, as follows: That this petition was filed in said Court on the 7th day of June 2017. That, in accordance with the provisions of the laws aforesaid of the General Assembly, a Declaration of Taking duly authorized and properly executed as provided by said statute, has been made and filed in said case, declaring the necessity for and exercising the power of taking, the said described land for public road purposes, (paving Foxthick Road) thereby vesting the title to same in the Board of Commissioners of Colquitt County, Georgia; and, in pursuant of such authority, the Board of Commissioners of Colquitt County, Georgia, has deposited with the Clerk of the Superior Court of said County $1,315.00 as just compensation for the said land described; and all persons claiming such fund or any interest therein, are hereby required to make known their claims to the Court. That in accordance with Official Code of Georgia sect. 32-3-14, if the owner, or any of the owners, or any person having a claim against or interest in said property, shall be dissatisfied with the compensation, as estimated in the Declaration of Taking and deposited in Court, such person or persons, or any of them shall have the right, at anytime subsequent to the filing of the Declaration of the deposit of the fund into Court, but not later than 30 days following the date of service as provided for in Sect. 32-3-8, to file with the Court a notice of appeal, the same to be in writing and made a part of the record into proceedings. The improvements to Foxthick Road do not change the location of the road. A plat or map of the project showing the exact location is recorded at Plat Book 45, Pages 14B and 15A, in the Office of the Clerk of Superior Court of Colquitt County, and any interested party may obtain a copy of same from the Clerk of the Superior Court of Colquitt County, and paying a nominal cost therefor. The said property, as thus affected is described as follows: All that certain piece, parcel or tract of land situate, lying and being in Land Lot 386 of the 8th Land District of Colquitt County, Georgia, containing 0.35 acres and being shown as Parcel 6 (Larry A. Hunt and Lance Hunt) on a plat entitled "R/W Survey for Colquitt County Board of Commissioners - Proposed 40' and 60' R/W for County Road 386 Foxthick Road", dated November 21, 2016, prepared by Daniel L. Hinson, Georgia RLS, a copy of which is recorded in Plat Book 45, Pages 14B and 15A, in the office of the Clerk of the Superior Court of Colquitt County, Georgia, the contents of which are incorporated herein by reference, and said Parcel 6 being shown on Pages 1 and 2 of said Plat.
