NOTICE OF SALE UNDER POWER STATE OF GEORGIA COUNTY OF RICHMOND Under and by virtue of the power of sale contained with that certain Security Deed dated April 1, 2011, from Mable Davis Johnson to Wells Fargo Bank, N.A., recorded on April 8, 2011 in Deed Book 1298 at Page 511, Richmond County, Georgia Records, having been last sold, assigned, transferred and conveyed to Wells Fargo Bank, N.A. by Assignment and said Security Deed having been given to secure a note dated April 1, 2011, in the amount of $94,500.00, said note being in default, the undersigned will sell at public outcry during the legal hours of sale before the door of the courthouse of Richmond County, Georgia, on August 1, 2017, the following described real property (hereinafter referred to as the "Property"): ALL THAT LOT OR PARCEL OF LAND WITH IMPROVEMENTS THEREON SITUATE, LYING AND BEING IN THE CITY OF AUGUSTA, COUNTY OF RICHMOND, STATE OF GEORGIA, BEING KNOWN AND DESIGNATED AS LOT 9 UPON A PLAT OF PINE HILL ESTATE SUBDIVISION AS SHOWN UPON PLATS RECORDED IN THE OFFICE OF THE CLERK OF SUPERIOR COURT OF RICHMOND COUNTY, GEORGIA IN REALTY BOOK 16-Q, PAGE 477 AND REALTY BOOK 16-B, PAGE 17. REFERENCE BEING MADE TO BOTH PLATS FOR A MORE COMPLETE AND ACCURATE DESCRIPTION AS TO METES, BOUNDS AND LOCATIONS OF SAID PROPERTY. The debt secured by the Security Deed and evidenced by the Note and has been, and is hereby, declared due and payable because of, among other possible events of default, failure to make the payments as required by the terms of the Note. The debt remaining is in default and this sale will be made for the purposes of paying the Security Deed, accrued interest, and all expenses of the sale, including attorneys' fees. Notice of intention to collect attorneys' fees has been given as provided by law. To the best of the undersigned's knowledge, the person(s) in possession of the property is/are Mable Davis Johnson and Miriam D. Marson with Mable Davis Johnson retaining a Life Estate The property, being commonly known as 2817 Oakland Ave, Augusta, GA, 30909 in Richmond County, will be sold as the property of Mable Davis Johnson and Miriam D. Marson with Mable Davis Johnson retaining a Life Estate, subject to any outstanding ad valorem taxes (including taxes which are a lien and not yet due and payable), any matters affecting title to the property which would be disclosed by accurate survey and inspection thereof, and all assessments, liens, encumbrances, restrictions, covenants, and matters of record to the Security Deed.
