NOTICE OF SALE UNDER POWER GEORGIA, RICHMOND COUNTY By virtue of a Power of Sale contained in that certain Security Deed from Ollie W Lee to INTERBAY FUNDING LLC., dated April 30, 2002, recorded May 9, 2002, in Deed Book 788, Page 2148, Richmond County, Georgia Records, said Security Deed having been given to secure a Note of even date in the original principal amount of Two Hundred Thousand and 00/100 dollars ($200,000.00), with interest thereon as provided for therein, said Security Deed having been last sold, assigned and transferred to Bayview Loan Servicing, LLC a Delaware Limited Liability Company, there will be sold at public outcry to the highest bidder for cash at the Richmond County Courthouse, within the legal hours of sale on the first Tuesday in August, 2017, all property described in said Security Deed including but not limited to the following described property: ALL THAT TRACT OR PARCEL OF LAND, WITH IMPROVEMENTS THEREON, SITUATE, LYING AND BEING IN THE STATE OF GEORGIA, COUNTY OF RICHMOND, AND BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS: BEGIN AT A POINT WHICH MARKS THE NORTHWEST INTERSECTION OF THE RIGHT OF WAY OF THOMAS LANE AND THE RIGHT OF WAY OF JENNINGS ROAD; PROCEED THENCE IN A NORTHERLY DIRECTION ALONG THE WESTERN RIGHT OF WAY OF THE SAID JENNINGS ROAD A DISTANCE OF 61.54 FEET TO A POINT; CONTINUE IN A NORTHERLY DIRECTION ALONG THE WESTERN RIGHT OF WAY OF SAID JENNINGS ROAD A DISTANCE OF 212.86 FEET TO A POINT; THENCE PROCEED NORTH 72 DEGREES, 08 MINUTES, 30 SECONDS WEST A DISTANCE OF 596.44 FEET TO A POINT; THENCE PROCEED SOUTH 17 DEGREES, 51 MINUTES, 30 SECONDS WEST A DISTANCE OF 181.90 FEET TO A POINT; THENCE PROCEED SOUTH 72 DEGREES, 08 MINUTES, 30 SECONDS EAST A DISTANCE OF 71.15 FEET TO A POINT; THENCE PROCEED SOUTH 17 DEGREES, 36 MINUTES EAST A DISTANCE OF 132.0 FEET TO A POINT; THENCE PROCEED SOUTH 72 DEGREES, 08 MINUTES, 30 SECONDS EAST A DISTANCE OF 272.50 FEET TO A POINT; THENCE PROCEED SOUTH 24 DEGREES, 24 MINUTES, 27 SECONDS EAST A DISTANCE OF 138.80 FEET TO A POINT ON THE NORTHERNMOST RIGHT OF WAY OF THE SAID THOMAS LANE; THENCE PROCEED ALONG THE NORTHERN RIGHT OF WAY OF THE SAID THOMAS LANE A DISTANCE OF 230.33 FEET TO A POINT THENCE PROCEED NORTH 80 DEGREES, 26 MINUTES, 08 SECONDS EAST ALONG THE NORTHERN RIGHT OF WAY OF THE SAID THOMAS LANE A DISTANCE OF 62.73 FEET TO THE POINT OF BEGINNING. SAID PROPERTY IS MORE PARTICULARLY SHOWN ON A PLAT PREPARED BY FRANKLIN A. TOOLE, GEORGIA REGISTERED LAND SURVEYOR NO. 1420 OF TOOLE SURVEYING COMPANY, WHICH IS FILED FOR RECORD AT REEL 195, PAGE 1581 IN THE OFFICE OF THE CLERK OF SUPERIOR COURT OF RICHMOND COUNTY, GEORGIA. Said legal description being controlling, however the property is more commonly known as 2507 Thomas Lane, Augusta, GA 30916. The indebtedness secured by said Security Deed has been and is hereby declared due because of default under the terms of said Security Deed and Note. The indebtedness remaining in default, this sale will be made for the purpose of paying the same, all expenses of the sale, including attorneys' fees (notice to collect same having been given) and all other payments provided for under the terms of the Security Deed and Note. Said property will be sold on an "as-is" basis without any representation, warranty or recourse against the above-named or the undersigned. The sale will also be subject to the following items which may affect the title: any outstanding ad valorem taxes (including taxes which are a lien, whether or not now due and payable); the right of redemption of any taxing authority; matters which would be disclosed by an accurate survey or by an inspection of the property; all zoning ordinances; assessments; liens; encumbrances; restrictions; covenants, and any other matters of record superior to said Security Deed. To the best of the knowledge and belief of the undersigned, the owner and party in possession of the property is Ollie W Lee, or tenants(s). The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the Security Deed.
