NOTICE OF SALE UNDER POWER GEORGIA, RICHMOND COUNTY Under and by virtue of the power of sale contained in a Deed to Secure Debt from Wayne L. Wagner to Askin Enterprises, Ltd. Co., A Georgia Corporation, dated November 7, 2000, recorded in Deed Book 707, Pages 2411-2414, Richmond County, Georgia records. Said Deed to Secure Debt having been given to secure a note dated November 7, 2000, in the original principal sum of Eight Thousand Nine Hundred and 00/100 ($8,900.00) Dollars with interest from date at the rate stated in said note on the unpaid balance until paid, there will be sold by the undersigned at public outcry to the highest bidder for cash before the courthouse door at Richmond County, Georgia within the legal hours of sale on the first Tuesday in August, 2017, the property described in said Deed to Secure Debt, to wit: All that lot or parcel of land, situate, lying, and being in the 86th G.M.D., Richmond County, Georgia, containing 0.46 acres, more or less, and being known and designated as Lot 3, Block A, fronting a distance of 100.00 feet on Bennock Mill Road, as shown on a plat thereof prepared by H. Lawson Graham & Associates, Reg. Land Surveyor, which plat is of record in the Office of the Superior Court Clerk for Richmond County, Georgia in Plat Reel 586, Page 721; reference being made to said plat for a more complete and accurate description of said property. Said property is commonly known as 793 Bennock Mill Road, Augusta, Georgia 30906. The debt secured by said Deed to Secure Debt has been and is hereby declared due because of, among other possible events of default, the non-payment of the monthly installments on said loan. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, including legal fees. This sale will be held subject to all unpaid taxes, assessments, and restrictions of record, if any, transfer tax and all state and county taxes. Wayne L. Wagner having passed away, said property will be sold as the property of the Estate of Wayne L. Wagner, the property to the best information, knowledge, and belief of the undersigned, being presently in the possession of the Estate of Wayne L. Wagner, and the proceeds of said sale will be applied to the payment of said indebtedness and all the expenses of said sale, including attorney's fees, all as provided in said deed, and the balance, if any, will be distributed as provided by law.
