NOTICE OF SALE UNDER POWER GEORGIA, RICHMOND COUNTY Under and by virtue of the Power of Sale contained in a Security Deed from MICHAEL JAMES to MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INC. AS NOMINEE FOR FIRST CHOICE MORTGAGE INC, A GEORGIA CORPORATION dated AUGUST 22, 2005, and recorded on SEPTEMBER 12, 2005, in DEED BOOK 1013, PAGE 489, of the RICHMOND County, Georgia Records; as last assigned to PLANET HOME LENDING, LLC, by Assignment recorded in aforesaid records; conveying the after-described property to secure a Note in the original principal amount of THIRTY FIVE THOUSAND, FOUR HUNDRED FORTY THREE Dollars and 00/100 ($35,443.00) with interest thereon as set forth therein, there will be sold at public outcry to the highest bidder for cash before the courthouse door of RICHMOND County, Georgia, within the legal hours of sale on the first TUESDAY in AUGUST, 2017 the following described property: ALL THAT lot or parcel of land, with improvements thereon, situate, lying and being in the State of Georgia, County of Richmond, being in the City of Augusta, being known and designated as Lot 50 on the North side of Clark Street, formerly known as First Street, and also known as Jones Street, as shown upon a plat recorded in the Office of the Clerk of the Superior Court of Richmond County, Georgia in Realty Book 3-M, Page 286-287; said lot has a frontage of 50 feet on Clark Street and extends back between lines a distance of 144 feet and is bounded; North by an alley; East by Lot No. 49 on said plat; South by Clark street; and West by Lot No. 51 on said plat. Reference is hereby made to said plat for a more complete and accurate description as to the metes, bounds and location of said property. The improvements on said lot are known under the present system of street numbering in the City of Augusta as 2013 Clark Street. The indebtedness secured by said Security Deed has been and is hereby declared due and payable because of, among other possible events of default, non-payment of the monthly installments as required by said Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the Security Deed and by law, including attorney's fees (notice of intent to collect attorney's fees having been given) and all other payments provided for under the terms of the Security Deed and Note. Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above. The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the security deed.
