NOTICE OF FORECLOSURE SALE UNDER POWER RICHMOND COUNTY, GEORGIA THIS IS AN ATTEMPT TO COLLECT A DEBT. ANY INFORMATION OBTAINED WILL BE USED FOR THAT PURPOSE. Under and by virtue of the Power of Sale contained in a Security Deed given by Barbara McGruder and Roosevelt McGruder to American General Financial Services, Inc., dated December 8, 2006, and recorded in Deed Book 01093, Page 2083, Richmond County, Georgia Records, subsequently modified by a Loan Modification Agreement recorded May 4, 2009 in Book 1215, Page 1291 in the amount of Twenty-Seven Thousand Eighty-Two and 37/100 ($27,082.37) Richmond County, Georgia Records, as last transferred to U.S. Bank National Association as Indenture Trustee for CSMC Trust 2014-CIM1 Mortgage-Backed Notes, Series 2014-CIM1 by assignment recorded on May 5, 2017 in Book 1578 Page 356 in the Office of the Clerk of Superior Court of Richmond County, Georgia Records, conveying the after-described property to secure a Note in the original principal amount of Thirty Thousand Three Hundred Sixty-Two and 50/100 dollars ($30,362.50), with interest thereon as set forth therein, there will be sold at public outcry to the highest bidder for cash before the courthouse door of Richmond County, Georgia, within the legal hours of sale on August 1, 2017, the following described property: All that lot or parcel of land, with improvements thereon, situate, lying and being in the Turpin Hill Subdivision, in Richmond County, Georgia, having a frontage of 65 feet on the southeast side of Grand Boulevard and extending back between parallel lines a distance of 150 feet to an alley, and being known an designated as Lot No. 5 in Block 25, as shown on a plat of said subdivision which is recorded in the Office of the Clerk of the Superior Court of Richmond County, Georgia in Realty Book 4-C's, Pages 772-3. Reference being hereby made to said plat for a more accurate description of the metes, bounds and location. The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in Security Deed and by law, including attorney's fees (notice of intent to collect attorney's fees having been given). Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above. To the best knowledge and belief of the undersigned, the party in possession of the property is Barbara McGruder or tenant(s); and said property is more commonly known as 2220 Grand Boulevard, Augusta, GA 30906. The sale will be conducted subject to (1) confirmation that the sale is not prohibited under the U.S. Bankruptcy Code (2) final confirmation and audit of the status of the loan with the holder of the security deed and (3) any right of redemption or other lien not extinguished by foreclosure.
