Under and by virtue of the power of sale contained with that certain Security Deed dated October 7, 2016, from John Albano, Jr. and Anna Albano to Mortgage Electronic Registration Systems, Inc. as nominee for Loandepot.com, LLC, recorded on October 24, 2016 in Deed Book 54677 at Page 668, Gwinnett County, Georgia Records, having been last sold, assigned, transferred and conveyed to Lakeview Loan Servicing, LLC by Assignment and said Security Deed having been given to secure a note dated October 7, 2016, in the amount of $129,222.00, said note being in default, the undersigned will sell at public outcry during the legal hours of sale before the door of the courthouse of Gwinnett County, Georgia, on August 1, 2017, the following described real property (hereinafter referred to as the Property): THE FOLLOWING DESCRIBED PROPERTY SITUATED IN GWINNETT COUNTY. GEORGIA, TO.WIT: ALL THAT TRACT OR PARCEL OF LAND LYING AND BEING IN LAND LOT 346 OF THE 4TH DISTRICT, GWINNETT COUNLY, GEORGIA, BEING LOT 13 AND PART OF LOT 14, BLOCK 35, NORRIS LAKE SHORES SUBDIVISION, SECTION SIX, AND BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS: BEGINNING AT A POINT ON THE NORTHERLY SIDE OF LAKE DRIVE (A 50 FOOT RIGHT OF WAY) 260.0 FEET FROM THE INTERSECTION OF LAKE DRIVE AND LUCY LANE (A 50 FOOT RIGHT OF WAY); THENCE RUNNING NORTH 66 DEGREES 12 MINUTES 03 SECONDS WEST, 196.92 FEET TO AN IRON PIN, THENCE RUNNING NORTH 62 DEGREES 45 MINUTES 40 SECONDS EAST, 104.20 FEET TO AN IRON PIN; THENCE RUNNING SOUTH 65 DEGREES 22 MINUTES 18 SECONDS EAST, 144.44 FEET TO AN IRON PIN; THENCE RUNNING SOUTH 33 DEGREES 10 MINUTES 22 SECONDS WEST, 80.00 FEET TO THE TRUE POINT OF BEGINNING. P.I.D#: R4346B085 The debt secured by the Security Deed and evidenced by the Note and has been, and is hereby, declared due and payable because of, among other possible events of default, failure to make the payments as required by the terms of the Note. The debt remaining is in default and this sale will be made for the purposes of paying the Security Deed, accrued interest, and all expenses of the sale, including attorneys fees. Notice of intention to collect attorneys fees has been given as provided by law. To the best of the undersigneds knowledge, the person(s) in possession of the property is/are John Albano, Jr. and Anna Albano. The property, being commonly known as 585 Lake Dr. Snellville, GA, 30039 in Gwinnett County, will be sold as the property of John Albano, Jr. and Anna Albano, subject to any outstanding ad valorem taxes (including taxes which are a lien and not yet due and payable), any matters affecting title to the property which would be disclosed by accurate survey and inspection thereof, and all assessments, liens, encumbrances, restrictions, covenants, and matters of record to the Security Deed.Pursuant to O.C.G.A.Section 44-14-162.2, the name, address and telephone number of the individual or entity who shall have the full authority to negotiate, amend or modify all terms of the above described mortgage is as follows: Cenlar FSB, 425 Phillips Blvd., Ewing, NJ 08628, 800-223-6527.
