NOTICE OF SALE UNDER POWER STATE OF GEORGIA COUNTY OF GWINNETT Under and by virtue of the power of sale contained in that certain Deed to Secure Debt, Assignment of Rents and Security Agreement (Security Deed) executed by International One Investments, LLC in favor of Flor Ramos dated October 1, 2014, recorded at Deed Book 53186, Pages 652-670 of the Gwinnett County Deed Records, the undersigned will sell at public outcry to the highest bidder for cash before the door of the Courthouse of Gwinnett County, Georgia, during the legal hours of sale, on the first Tuesday in August, that being August 1, 2017, the following described property: TRACT ONE: All that tract or parcel of land lying and being in Land Lots 229 and 259 of the 7th Land District, Gwinnett County, Georgia, being more particularly described as follows: To find the point of beginning, commence at the intersection of the westerly right of way of South Lee Street (right of way varies) and the northerly right of way of Georgia Highway No 20 (right of way varies) if extended to form a point; thence along said northerly right of way of Georgia Highway No 20 for a distance of 1303.55 feet to a point, thence leaving said right of way and traveling North 18 degrees 15 minutes 12 seconds East for a distance of 206.62 feet to a point, said point marked by a 1/2 inch rebar pin set, said point being the true point of beginning, thence from said point as thus established, North 81 degrees 28 minutes 34 seconds West for a distance of 138.55 feet to a point, said point marked by a 1/2 inch rebar pin set, thence North 18 degrees 22 minutes 28 seconds East for a distance of 67.50 feet to a point, said point marked by a 1/4 inch rebar pin found, thence South 60 degrees 23 minutes 57 seconds West for a distance of 290.78 feet to a point, said point marked by a 1/2 inch rebar pin set, thence North 29 degrees 39 minutes 02 seconds West for a distance of 283.36 feet to a point, said point marked by a 1/2 inch rebar pin set; thence North 59 degrees 31 minutes 18 seconds East for a distance of 650.07 feet to a point, said point marked by a 1/2 inch rebar pin set; thence South 29 degrees 39 minutes 02 seconds East for a distance of 293.31 feet to a point, said point marked by a 1/2 inch rebar pin set, thence South 60 degrees 23 minutes 57 seconds West for a distance of 20.73 feet to a point, said point marked by a 1/2 inch rebar pin found, thence South 18 degrees 26 minutes 16 seconds West for a distance of 224.51 feet to a point, said point marked by a 1/2 inch rebar pin found, thence North 71 degrees 44 minutes 42 seconds West for a distance of 90.00 feet to a point, said point marked by a 1/2 inch rebar pin set; thence South 18 degrees 15 minutes 12 seconds West for a distance of 70.55 feet to a point, said point marked by a 1/2 inch rebar pin set, said point being the true point of beginning. Easements and Restrictive Covenants Agreement by and between JDN Enterprises, Inc and E E Robinson Properties, Inc., dated March 7, 1988, filed March 8, 1988, recorded in Deed Book 4787, Page 157, Gwinnett County, Georgia Records, as amended by First Amendment dated and filed May 4, 1988, recorded in Deed Book 4876, Page 145, aforesaid records, as further amended by Second Amendment dated August 22, 1988, filed June 14, 1989, recorded in Deed Book 5518, Page 189, aforesaid records. b. Easements contained in Warranty Deed from E E Robinson Properties to Jacob Foods, Inc., dated October 5, 1994, filed October 10, 1994, recorded in Deed Book 10750, Page 309, aforesaid records. c. Non-Exclusive Driveway Easement Agreement by and between Sons Barnett Buford RE, LLC and Bainbridge Management, Inc., dated September 22, 2005, filed January 3, 2006, recorded in Deed Book 45894, Page 61, aforesaid records. TRACT TWO: All that tract or parcel of land lying and being in Land Lot 229 of the 7th District, City of Buford, Gwinnett County, Georgia, and being shown and delineated as Tract 1 on plat of survey prepared for Jacobs Foods by Precision Planning, Inc., Georgia Registered Land Surveyors, dated August 2, 1994, being more particularly described as follows: Beginning at an iron pin set on the northerly right of way of Georgia Highway No 20 which is located 1303.55 feet west of the intersection of Georgia Highway No. 20 and South Lee Street, thence along the right of way of Georgia Highway No. 20 North 81 degrees 09 minutes 39 seconds West 138.87 feet to an iron pin set, thence along property, now or formerly Lees Crossing Limited Partnership, North 18 degrees 22 minutes 28 seconds East 210 feet to an iron pin set; thence along property, now or formerly E.E. Robinson Properties South 81 degrees 28 minutes 34 seconds East 138.55 feet to an iron pin set; thence along property, now or formerly, Buford Restaurant Partnership South 18 degrees 15 minutes 12 seconds West 210.70 feet to an iron pin set and the point of beginning. Said tract or parcel of land containing 0.66 acres, more or less. TOGETHER WITH a perpetual non-exclusive easement for ingress and egress by vehicular and pedestrian traffic 20 feet in width over Tract 2 as shown on afore referenced plat. The purpose of this easement is to allow access from Tract 1 to Lees Crossing Shopping Center. ALSO TOGETHER WITH a perpetual non-exclusive easement for ingress and egress by vehicular and pedestrian traffic from the curb cut on Highway No 20 to the above-referenced Tract 1, approximately 25 feet in width, all as shown on aforesaid plat of survey. The debt secured by said Security Deed is evidenced by the Final Judgment and Decree of Divorce in the case of Flor Yesenia Ramos v. Fernando Lara-Martinez, Case No. 12-CV-718J, Superior Court of Hall County filed December 3, 2013 (the Final Judgment and Decree). Default has occurred in the payment of the debt evidenced by the Final Judgment and Decree and secured by the Security Deed as a result of the nonpayment of installments owed thereunder. The total balance of said debt has, therefore, been declared due and the Security Deed foreclosable according to its terms. The debt remaining in default, the property will be sold to the highest bidder for cash as the property of International One Investments, LLC, the proceeds to be applied to the payment of said indebtedness, attorneys fees (notice of intention to collect attorneys fees having been given), and the lawful expenses of said sale, all as provided in the Final Judgment and Decree and the Security Deed, said sale to be subject to any and all unpaid taxes and assessments, and restrictions, easements and liens of record with priority over the Security Deed referenced above. To the best of the undersigneds knowledge and belief, the property is in the possession of International One Investments, LLC and will be sold as the property of International One Investments, LLC.
