STATE OF GEORGIA COUNTY OF GWINNETT NOTICE OF SALE UNDER POWER Under and by virtue of the power of sale contained in a Security Deed from GLOBAL EMPOWERMENT MINISTRIES, INC. to CAPITAL MORTGAGE CORPORATION (as to a 81% undivided interest), FIRST FINANCIAL FUNDING, INC. (as to a 15% undivided interest) and PRIME EQUITY LENDING, INC. (as to a 4% undivided interest), dated September 5, 2008, recorded September 9, 2008, in Deed Book 49064, Page 6, Gwinnett County, Georgia records, as modified by Modification Agreement dated April 11, 2012, recorded in Deed Book 51647, Page 910, Gwinnett County, Georgia records, as last transferred to CRIMSON PORTFOLIO, LLC by Assignment of Security Instrument recorded in Deed Book 52922, Page 859, Gwinnett County, Georgia records and by Transfer and Assignment recorded in Deed Book 54296, Page 645, Gwinnett County, Georgia records, said Security Deed being given to secure a Note from GLOBAL EMPOWERMENT MINISTRIES, INC. dated September 5, 2008 in the original principal amount of Two Million Six Hundred Twenty Five Thousand and 00/100 ($2,625,000.00) Dollars, with interest thereon on the unpaid balance until paid; there will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door at Gwinnett County, Georgia, within the legal hours of sale on the first Tuesday in August, 2017, the following described property: All that tract or parcel of land lying and being in Land Lot 77 of the 6th Land District of Gwinnett County, Georgia, and being more particularly described as follows: BEGINNING at a 1 1/2 inch iron pin situated on the northerly right-of-way of Pounds Road (80 foot right-of-way) at a point where the northerly right-of-way of Pounds Road and the line dividing Land Lots 76 and 77 intersect said right-of-way; running thence along the right of way line of Pounds Road 493.88 feet on a radius of 11499.16 feet subtended by a chord of 493.84 feet on a chord bearing of South 61 degrees 49 minutes 32 seconds West; running thence North 28 degrees 55 minutes 21 seconds West 492.20 feet to an iron pin; running thence North 62 degrees 00 minutes 55 seconds East 500.79 feet to an iron pin situated on the line dividing Land Lots 76 and 77; running thence South 28 degrees 06 minutes 48 seconds East 490.50 feet to an iron pin situated on the northerly right-of-way of Pounds Road and the point of beginning. AND All that tract or parcel of land lying and being in Land Lots 60 and 61 of the 6th Land District of Gwinnett County, Georgia. and being more particularly described as follows: BEGINNING at an iron pin and corner formed by the southerly right-of-way of Pounds Road (80 feet right-of-way) and the northerly right-of-way of Rockbridge Road (right-of-way varies); running thence North 62 degrees 16 minutes 28 seconds East along the southerly right-of-way of Pounds Road 337.73 feet to an iron pin; thence continuing along the right-of-way of Pounds Road 505.07 feet on a radius of 11419.16 feet subtended by a chord of 505.03 feet on a chord bearing of North 61 degrees 51 minutes 44 seconds East to a number 4 rebar; running thence South 28 degrees 18 minutes 29 seconds East 439.11 feet to a number 4 rebar; thence running South 16 degrees 59 minutes 20 seconds West 45.61 feet to a number four rebar; running thence North 74 degrees 14 minutes 13 seconds West 377.54 feet to a number 4 rebar; running thence South 30 degrees 19 minutes 32 seconds West 373.99 feet to an iron pin situated on the northerly right-of-way of Rockbridge Road; running thence along the right-of-way of Rockbridge Road 206.02 feet on a radius of 1420.39 feet subtended by a chord of 205.84 feet on a chord bearing of North 58 degrees 55 minutes 37 seconds West; running thence South 35 degrees 13 minutes 27 seconds West 2.63 feet; continuing thence along the northerly right-of-way of Rockbridge Road North 54 degrees 09 minutes 53 seconds West 258.06 feet to an iron pin situated at the corner formed by the southerly right-of-way of Pounds Road and the northerly right-of-way of Rockbridge Road which point is the point of beginning. Said tract contains 5.8219 acres and is designated as Tract B on that certain plat of survey dated February 2, 2000 prepared for The Waterton/Westchester Management Group by B. L. Bruner Land Surveyors, Civil Engineering Technologist and Land Planners which plat is referred to and made a part hereof by reference. The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the Security Deed and by law, including attorneys fees (notice of intent to collect attorneys fees having been given). Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, easements, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
