STATE OF GEORGIA COUNTY OF RICHMOND NOTICE OF SALE UNDER POWER Because of a default under the terms of the Security Deed executed by Andrew D. Pittman and Natalie H. Pittman to Mortgage Electronic Registration Systems, Inc., as nominee for America's Wholesale Lender, its successors and assigns dated May 2, 2006, and recorded in Deed Book 1055, Page 1209, Richmond County Records, said Security Deed having been last sold, assigned, transferred and conveyed to Green Tree Servicing LLC securing a Note in the original principal amount of $83,000.00, the holder thereof pursuant to said Deed and Note thereby secured has declared the entire amount of said indebtedness due and payable and, pursuant to the power of sale contained in said Deed, will on the first Wednesday, July 5, 2017, during the legal hours of sale, before the Courthouse door in said County, sell at public outcry to the highest bidder for cash, the property described in said Deed, to-wit: ALL THAT TRACT OR PARCEL OF LAND, WITH IMPROVEMENTS THEREON, SITUATE, LYING AND BEING IN THE 1269TH DISTRICT, OF G.M. RICHMOND COUNTY, GEORGIA, ABOUT NINE (9) MILES FROM THE CITY OF AUGUSTA, ON THE SOUTH SIDE OF WRIGHTSBORO ROAD, FRONTING ON WRIGHTSBORO ROAD A DISTANCE OF THREE HUNDRED NINETY THREE AND SIX TENTHS (393.6) FEET, THENCE IN A SOUTHEASTERLY DIRECTION ALONG RAE'S CREEK ON ITS EASTERN LINE A DISTANCE OF TWO HUNDRED FIFTEEN (215) FEET; THENCE IN A SOUTHWESTERLY DIRECTION ALONG A LINE DIVIDING IT FROM LANDS OF LEVY ESTATE AND NATHAN BASKIN BROWN A DISTANCE OF FOUR HUNDRED EIGHTY FIVE (485) FEET, THENCE IN A NORTHWESTERLY DIRECTION ALONG A LINE DIVIDING IT FROM LANDS OF LEVY ESTATE A DISTANCE OF TWENTY FIVE AND ONE TENTH (25.1) FEET, THENCE IN A NORTHERLY DIRECTION ALONG A LINE DIVIDING IT FROM OTHER LANDS OF PART OF THE FIRST PART MARKED "PART NO. 2" ON PLAT RECORDED IN THE RECORDS OF CLERK OF SUPERIOR COURT OF RICHMOND COUNTY, GEORGIA, IN REALTY BOOK 26-W, PAGE 220, DISTANCE OF THREE HUNDRED NINETY SIX AND TWO TENTHS (396.2) FEET, BOUNDED NORTH BY WRIGHTSBORO ROAD; EAST BY RAE'S CREEK; SOUTH BY LANDS OF LEVY ESTATE AND NATHAN BASKIN BROWN, AND WEST BY LANDS OF LEVY ESTATE AND OTHER LANDS OF PARTY OF THE FIRST PART. THE SAID PARTY OF THE FIRST PART ALSO GRANTS, BARGAINS AND CONVEYS TO THE SAID PARTIES OF THE SECOND PART, THEIR HEIRS AND ASSIGNS, ALL WATER RIGHTS, DESCRIBED IN A DEED FROM ANNA MAY MURRAY TO ROBERT E. CAWLEY, HIS HEIRS AND ASSIGNS, BY DEED DATED OCTOBER 5, 1944, AND RECORDED IN THE OFFICE OF THE CLERK OF SUPERIOR COURT OF RICHMOND COUNTY, GEORGIA, IN DEED BOOK 15-E, PAGE 299. Said property is known as 3808 Wrightsboro Road, Augusta, GA 30909, together with all fixtures and personal property attached to and constituting a part of said property, if any. Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, whether or not now due and payable), the right of redemption of any taxing authority, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above. The proceeds of said sale will be applied to the payment of said indebtedness and all expenses of said sale as provided in said Deed, and the balance, if any, will be distributed as provided by law. The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the secured creditor. The property is or may be in the possession of Andrew D. Pittman, Natalie H. Pittman and Dale P. Seber, The Executrix for the Estate of Natalie H. Pittman, successor in interest or tenant(s).
