STATE OF GEORGIA COUNTY OF RICHMOND NOTICE OF SALE UNDER POWER Under and by virtue of the power of sale granted by REX A. FIELD & TRACY FIELD ("Grantor") to CECIL L. COLLINS, JR. AND PATRICK T. COLLINS ("Grantee") in that certain Deed to Secure Debt dated APRIL 3, 2000, and recorded in the Office of the Clerk of the Superior Court of RICHMOND County, Georgia, in Deed Book 682, Page(s) 2178, et seq., Grantee will offer for sale at public outcry before the Courthouse Door, in RICHMOND County, Georgia, within the legal hours of sale on the First WEDNESDAY in JULY 2017, being JULY 5, 2017, for CASH to the highest bidder, the purchaser paying the transfer tax, all costs of preparing and recording a deed of conveyance, ad valorem taxes and all other assessments or liens against the property, if any, the following-described properties, to-wit: SEE "EXHIBIT A" ATTACHED HERETO The above-referenced Deed to Secure Debt was given to secure an indebtedness evidenced by a Promissory Note in the original principal amount of ONE HUNDRED THIRTY THOUSAND 00/100 DOLLARS ($130,000.00) with interest thereon, and also any renewals, extensions, or modifications of any such indebtedness in whole or in part and all future advances that were made by Grantee. The indebtedness secured by said Deed to Secure Debt has been and is again declared due and payable in full because of, among other events of default, the failure of Borrower to make payments when due in the manner provided in the Promissory Note. The indebtedness remaining in default, the sale will be made for the purpose of applying the proceeds thereof to the payment of the indebtedness secured by the said Deed to Secure Debt, accrued interest thereon, expenses of the sale, attorneys' fees (notice of intention to collect attorneys' fees having been given) and all other sums secured by the Deed to Secure Debt, and the remainder, if any, shall be applied as provided by said Deed to Secure Debt and by law. To the best of the undersigned's knowledge and belief, the property described on "Exhibit A" is in the possession of MASON DU ROI, LLC, or a tenant or tenants. The property is more commonly known as 507, 501, 513, AND 515 JAMES BROWN BOULEVARD, AUGUSTA, GEORGIA 30901. Said property will be sold as the property of REX A. FIELD & TRACY FIELD and subject to any outstanding ad valorem taxes (including taxes which are a lien, but are not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, zoning ordinances, covenants, all liens, encumbrances, easements, restrictions or other matters of record that may have priority over said Deed to Secure Debt, if any. The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U. S. Bankruptcy Code, and (2) to final confirmation and audit of the status of the Loan with the holder of the Deed to Secure Debt. In compliance with Official Code of Georgia Section 44-124-162.2, Grantee hereby states that the person with full authority to negotiate, amend, and modify all terms of the security deed with the debtor is Scott Klosinski, whose address is 1229 Augusta West Parkway, Augusta, Georgia 30909 and whose telephone number is 706-863-2255. "EXHIBIT A" Parcel 1: All those three lots or parcels of land with improvements thereon, situate, lying and being in the City of Augusta, Richmond County, Georgia, having a combined frontage of 108.10 feet on the West side of Campbell (9th) Street; between Telfair and Walker Streets, and extending back between parallel lines a distance of 120 feet and bounded North by property, now or formerly of Leroy Gepfert, formerly of 11A. Videtto; East by Campbell (9th); Street South by property now or formerly of Mose Anderson, and West by property now or formerly of Leroy Gepfert and other property of the Estate of Christina McCarthy Doolittle. Improvements are known under the present system of street numbering as 507, 509, 511, 513, and 515 Campbell (9th) Street, Augusta, Georgia, and are shown on Plat Book of the City Assessors' Office as Lots 12, 13 and 14, Block 28, Ward Three. A plat of said property made by Nisbet Wingfield, City Engineer, dated December 4, 1903, is attached to a deed front John B. Murray, Executor to John Frances McCarthy II, and recorded in the Office of the Clerk of the Superior Court of Richmond County, Georgia in Realty Book 18-G, pages 238-239. Parcel 2: Also, all of a small interior lot situate, lying and being in the City of Augusta, Richmond County, Georgia, in the rear and West of property known and designated as 515 Campbell (9th) Street, known and designated as Lot No. A as shown on a plat from the survey of the City of Augusta, made June 27, 1904, and recorded in said Clerk's Office in Realty Book 16-P, page 311, and being a portion of property conveyed to Anna McCarthy from William H. Harrison, et al, dated June 30, 1904, and recorded in said Clerk's Office in Realty Book 16-P, pages 210-311, except that portion of said Lot A which was conveyed by Christina McCarthy Doolittle to Armour and Company dated December 9, 1948, and recorded in said Clerk's Office in Realty Book 16-Z, page 135. Being a portion and shown to be the same property as that on a plat made by M.W. Hall Company, Surveyors, on August 14, 1952, which is attached to and made a part of the deed, and is designated as "remaining portion Lot A" and beginning on the Westernmost comer of said lot and extending in a Southerly direction a distance of 10.25 feet to a cyclone fence; thence in an Easterly direction a distance of 7.8 feet; thence in a Southerly direction a distance of 4.5 feet; thence in an Easterly direction a distance of 31.3 feet; thence in a Northerly direction a distance of 15 feet thence in a Westerly direction a distance of 38.3 feet to the point of beginning. Reference being made to all of the above plats and deeds for a more complete description as to metes, courses and bounds. Parcel 3: ALL THAT LOT OR PARCEL OF LAND, with improvements thereon, situate, lying and being in the City of Augusta, Richmond County, Georgia, on the Southwestern comer of Ninth (Campbell) Street and Telfair Street, fronting Fifty Three and Sixty Three one-hundredths (53.63) feet, more or less, on the West side of Ninth (Campbell) Street, and extending back between parallel lines on the South side of Telfair Street a distance of One Hundred Twenty (120') feet, and bounded on the North by Telfair Street East by Ninth Street, South by property now or formerly of Mrs. Burton Doolittle; and on the West by other property of Leroy Gepfert. Plat of said property being recorded in the Office of the Clerk of Superior Court, Richmond County, Georgia in Realty Book 16-H, Page 229, and by reference thereto, said plat is incorporated in this description as to the exact metes, bounds and location of said property. All of which are the identical properties conveyed to Grantors by deed of Cecil L. Collins, Sr. dated 12-1-86 recorded in the Richmond County Superior Court Clerk's Office in Deed Reel 246 at page 1646.
