NOTICE OF SALE UNDER POWER GEORGIA, RICHMOND COUNTY Under and by virtue of the Power of Sale contained in a Security Deed from DORIS D. HOFFMAN to MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INC. AS NOMINEE FOR MORTGAGE INVESTORS CORPORATION dated OCTOBER 27, 2010, and recorded on NOVEMBER 3, 2010 in DEED BOOK 1280, PAGE 942 as DOCUMENT NO. 2010045361 of the AUGUSTA-RICHMOND County, Georgia Records; as last assigned to GREEN PLANET SERVICING, LLC, N/K/A PLANET HOME LENDING, LLC by Assignment dated APRIL 15, 2013, and recorded on APRIL 22, 2013, recorded at DEED BOOK 1390, PAGE 1665 as DOCUMENT NO. 2013020708, aforesaid records; conveying the after-described property to secure a Note in the original principal amount of TWO HUNDRED SEVEN THOUSAND, TWENTY ONE Dollars and 00/100 ($207,021.00) with interest thereon as set forth therein, there will be sold at public outcry to the highest bidder for cash before the courthouse door of AUGUSTA-RICHMOND County, Georgia, within the legal hours of sale on the first WEDNESDAY in JULY, 2017, the following described property: THE LAND REFERRED TO HEREIN BELOW IS SITUATED IN THE COUNTY OF RICHMOND, STATE OF GA, AND IS DESCRIBED AS FOLLOWS: ALL THAT LOT, TRACT, OR PARCEL OF LAND, together with improvements thereon, if any, lying, being, and situate in the State of Georgia and County of Richmond, being known and designated as Lot 33 and a portion of Lot 34, Berckmans Hill Subdivision as shown on a plat of Section 2, recorded in the office of the Clerk of Superior Court of Richmond County, Georgia in Realty Reel 561 at page 1536, reference being made to said Plat for a more complete and accurate description as to metes, bounds, courses, locations and distances of said property. Said Property is conveyed subject to Protective Covenants recorded in said Clerk's Office in Realty Book 19-L, pages 21-23 and easement recorded in Realty Book 23-N, page 505; and also subject to any and all applicable easements and restrictions of record. The indebtedness secured by said Security Deed has been and is hereby declared due and payable because of, among other possible events of default, non-payment of the monthly installments as required by said Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the Security Deed and by law, including attorney's fees (notice of intent to collect attorney's fees having been given) and all other payments provided for under the terms of the Security Deed and Note. Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above. The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the security deed. To the best of the undersigned's knowledge and belief, said property is also known as 403 Ashland Drive, Augusta, Georgia 30909, and the party in possession of the property is Doris D.
