NOTICE OF SALE UNDER POWER GEORGIA, RICHMOND COUNTY By virtue of Power of Sale contained in Deed to Secure Debt from LOIS OGLESBY LEACH hereinafter Grantor(s), to SOUTHERN BANK, dated January 22, 2016, recorded in Deed Book 1517, Page 0091, Richmond County Records; said Deed to Secure Debt being given to secure a Note and Security Agreement in the original principal amount of $78,975.45; there will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door at Richmond County, Georgia, within the legal hours of sale on Wednesday, July 5, 2017 (Tuesday, July 4, 2017 being a legal holiday) the following described property: ALL THOSE tracts or parcels of land with improvements thereon, situate, lying and being in the State of Georgia, County of Richmond, being shown and designated as TRACTS TWO (2), THREE (3), FOUR (4), and FIVE (5), on plat for C. W. Oglesby, recorded Plat Book 9, Page 119 [Plat Cabinet D, Slide 177, Plat H] in the Office of the Clerk of the Superior Court of Richmond County, Georgia, reference being made to said plat for a more complete description as to the metes, bounds and location of said property. Also included is a 1980 Horton Summit Mobile Home, Serial #31021GLH31021GR which is permanently affixed to the land. This conveyance is made subject to all enforceable easements, rights-of-way, restrictions, and covenants of record or in existence upon said parcel. Said property is known as 4767, 4769, 4771 and 4773 Storey Mill Road, Hephzibah, GA 30815. The sale will be conducted subject to (1) confirmation that the sale is not prohibited under the U.S. Bankruptcy Code; and (2) final confirmation and audit of the status of the loan with the holder of the Security Deed. Pursuant to O.C.G.A. Section 9-13-172.1 which allows for certain procedures regarding the rescission of judicial and non-judicial sales in the State of Georgia, the Deed Under Power and other foreclosure documents may not be provided until final confirmation and audit of the status of the loan as provided immediately above. The debt secured by said Deed to Secure Debt has been and is hereby declared due because of, among other possible events of default, nonpayment of the monthly installments on said loan. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, including attorney's fees.
