Terrell to IndyMac Bank, F.S.B., a federally chartered savings bank dated 4/25/2002 and recorded in Deed Book 1236 Page 169 Newton County, Georgia records; as last transferred to or acquired by Nationstar Mortgage LLC, conveying the after-described property to secure a Note in the original principal amount of $ 145,600.00, with interest at the rate specified therein, there will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door of Newton County, Georgia (or such other area as designated by Order of the Superior Court of said county), within the legal hours of sale on July 05, 2017 (being the first Tuesday of said month unless said date falls on a Federal Holiday, in which case being the first Wednesday of said month), the following described property: All that tract or parcel of land lying and being in Land Lot 77 of the 10th District of Newton County Georgia, and being more particularly described as follows: Beginning at a point located on the southeasterly side of the 100 foot right of way of Brown Bridge Road, a chord measurement 440.34 feet (arc distance 440.80 feet) southwesterly from the point of intersection of the southeasterly side of the right of way of Brown Bridge Road and the westerly side of the 50 foot right of way of Magnet Road; thence south 65 degrees 25 minutes 55 seconds East 279.55 feet to a point; thence running in a southerly direction 329.03 feet to a point; thence north 47 degrees 46 minutes 03 seconds west 491.09 feet to a point located on the southeasterly side of Brown Bridge Road; thence north 45 degrees 16 minutes 24 seconds east 115 feet to a point; thence continuing along Brown Bridge Road north 46 degrees 56 minutes 42 seconds east a chord and arc measurement of 50.00 feet to the point of beginning; being a tract of land containing 1.90 acres and being designated as Tract 2, according to plat of same for Robert Harvill dated March 21, 1996 prepared by Louie D. Patrick RLS# 1757 which plat is incorporated herein by reference and made a part hereof for a more particular and complete description. The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed.
