gpn11 Foreclosures STATE OF GEORGIA COUNTY OF NEWTON NOTICE OF SALE UNDER POWER Because of a default under the terms of the Security Deed executed by Joy Jackson to Mortgage Electronic Registration Systems, Inc. as nominee for Sunshine Mortgage Corporation dated November 29, 2004, and recorded in Deed Book 1820, Page 383, Newton County Records, said Security Deed having been last sold, assigned, transferred and conveyed to Wells Fargo Bank, N.A. securing a Note in the original principal amount of $133,300.00, the holder thereof pursuant to said Deed and Note thereby secured has declared the entire amount of said indebtedness due and payable and, pursuant to the power of sale contained in said Deed, will on the first Wednesday, July 5, 2017, during the legal hours of sale, before the Courthouse door in said County, sell at public outcry to the highest bidder for cash, the property described in said Deed, to-wit: All that tract or parcel of land lying and being in Land Lot 165 of the 1st Land District, GMD 420, Newton County, Georgia, and being more particularly described as follows: BEGINNING at an iron pin located on the southerly side of the right-of-way of Alcovy Trestle Road (50 foot right-of-way), being 713.08 feet West from the Intersection of the southerly side of the right-of-way of said Alcovy Trestle Road (as it leaves the railroad right-of-way) and the right-of-way of the Ga. Railroad; thence running South 2 degrees 02 minutes 54 seconds East a distance of 170.64 feet to an Iron pin; thence running South 87 degrees 58 minutes 05 seconds west a distance of 498.02 feet to an Iron pin; thence running North 17 degrees 02 minutes 41 seconds East a distance of 303.29 feet to an iron pin found located on the southerly side of the right-of-way of said Alcovy Trestle Road; thence running along the southerly side of the right-of-way of said Alcovy Trestle Road South 75 degrees 49 minutes 01 seconds East a distance of 415.37 feet to an iron pin being the true point of beginning; said tract being 2.42 acres, as per survey prepared for Stewart Young and Eva Gay Young, dated June 19, 1999 and revised September 9, 1999 by John Elwin Knight, Ga. R.L.S. No. 1945. Said property is known as 1210 Alcovy Trestle Road, Social Circle, GA 30025, together with all fixtures and personal property attached to and constituting a part of said property, if any. Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, whether or not now due and payable), the right of redemption of any taxing authority, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above. The proceeds of said sale will be applied to the payment of said indebtedness and all expenses of said sale as provided in said Deed, and the balance, if any, will be distributed as provided by law.
