NOTICE OF SALE UNDER POWER
STATE OF GEORGIA
COUNTY OF MARION
Under and by virtue of the Power of Sale contained in a Deed to Secure Debt given by Nettie Minter in favor of New Horizons Habitat for Humanity of Greater Sumter County, Georgia, Inc., dated November 14, 2006, and filed for record on November 17, 2006 in Deed Book 169, Page 724, Marion County, Georgia Records, said Deed to Secure Debt having been given to secure certain indebtedness owed to New Horizons Habitat for Humanity of Greater Sumter County, Georgia, Inc., there will be sold by the undersigned at public outcry, during the legal hours of sale before the door of the Courthouse of Marion County, Georgia, on the first Wednesday in July, 2017, to wit: July 5, 2017, to the highest and best bidder for cash, the following described property:
All that tract or parcel of land, lying and being in the City of Buena Vista, Marion County, Georgia and being shown as Lot 1, Block B of Perry Subdivision as described on a plat of survey by Storey Surveying Co., dated November 26, 1974, and recorded in Plat Book B, Page 11, Marion County, Georgia, which is by reference made a part hereof.
Said property is subject to all easements, rights of way and restrictions on record and is known as 212 Church Street according to the current numbering system of said City.
The above-described property is more commonly known as 212 Church Street, Buena Vista, GA 31803.
According to the Marion County Tax Assessors Office, the above-described property is also identified as Tax Parcel Number: C05 3 44.
The debt secured by said Deed to Secure Debt has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Deed to Secure Debt. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, including attorneys fees.
Said property will be sold subject to (a) any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), (b) any matters which might be disclosed by an accurate survey and inspection of the property, and (c) all matters of record superior to the Deed to Secure Debt first set out above, including, but not limited to, assessments, liens, encumbrances, zoning ordinances, easements, restrictions, covenants, etc.
To the best knowledge and belief of the undersigned, the property is in the possession of Nettie Minter. New Horizons Habitat for Humanity of Greater Sumter County, Georgia, Inc. is the secured creditor under the Deed to Secure Debt and loan being foreclosed. The following shall have full authority to negotiate, amend and modify all terms of the above-described Deed to Secure Debt and associated notes on behalf of the secured creditor: Lori Gadson, New Horizons Habitat for Humanity of Greater Sumter County, Georgia, Inc., 512 Millard Fuller Blvd., Americus, GA 31709, (229) 928-9577. The secured creditor is not required by law to negotiate, amend or modify the terms of the mortgage instrument.
The sale will be conducted subject to (1) confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) final confirmation and audit of the status of the loan with the holder of the Deed to Secure Debt. The undersigned will execute a Deed Under Power to the purchaser as authorized by the aforementioned Deed to Secure Debt. Pursuant to O.C.G.A. 913172.1, which allows for certain procedures regarding the rescission of judicial and non-judicial sales in the State of Georgia, the Deed Under Power and other foreclosure documents may not be provided until final confirmation and audit of the status of the loan as provided in the preceding paragraph.
