NOTICE OF SALE UNDER POWER, GWINNETT COUNTY Pursuant to the Power of Sale contained in a Security Deed given by Steven W Van Desande Sr to Mortgage Electronic Registration Systems, Inc. as nominee for First Horizon Home Loan Corporation dated 1/12/2005 and recorded in Deed Book 41358 Page 47 Gwinnett County, Georgia records; as last transferred to or acquired by The Bank of New York Mellon F/K/A The Bank of New York as Trustee for FIRST HORIZON ALTERNATIVE MORTGAGE SECURITIES TRUST 2005-FA2, conveying the after-described property to secure a Note in the original principal amount of $ 193,050.00, with interest at the rate specified therein, there will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door of Gwinnett County, Georgia (or such other area as designated by Order of the Superior Court of said county), within the legal hours of sale on July 05, 2017 (being the first Tuesday of said month unless said date falls on a Federal Holiday, in which case being the first Wednesday of said month), the following described property: ALL THAT TRACT OR PARCEL OF LAND LYING AND BEING IN LAND LOT 106, 5TH DISTRICT, GWINNETT COUNTY, GEORGIA, BEING LOT 37, BLOCK A, THE ARBORS OF KNOLLWOOD LAKES, UNIT TWO, AS PER PLAT RECORDED IN PLAT BOOK 99, PAGE 190, GWINNETT COUNTY, GEORGIA, RECORDS, WHICH PLAT IS HEREBY REFERRED TO AND MADE A PART OF THIS DESCRIPTION. Pursuant to that Consent Judgment and Order, Civil Action File No. 16-A-01234-6, in the Superior Court of Gwinnett County, of record in Deed Book 55060, Page 164, Gwinnett County, Georgia Records, and that Order Granting Plaintiffs Motion for Summary Judgment, Civil Action File No. 16-A-01234-6, in the Superior Court of Gwinnett County, of record in Deed Book 55018, Page 313, Gwinnett County, Georgia Records, the above-referenced Security Deed of record in Deed Book 41358, Page 47, Gwinnett County, Georgia records, is enforceable as of the date of recordation and provides constructive and record notice of hte conveyance of the Property stated therein. It is further ordered The Bank of New York, Mellon, as Trustee for FIRST HORIZON ALTERNATIVE MORTGAGE SECURITIES TRUST 2005-FA2, holds a first-priorty secuirty interest in said Property. The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the Security Deed and by law, including attorneys fees (notice of intent to collect attorneys fees having been given).
