NOTICE OF SALE UNDER POWER
GEORGIA, SCHLEY COUNTY
THIS IS AN ATTEMPT TO COLLECT A DEBT. ANY INFORMATION OBTAINED WILL BE USED FOR THAT PURPOSE.
Under and by virtue of the power of sale contained in that certain Deed to Secure Debt given by Rebecca Ann Sinquefield f/k/a Rebecca Ann Fountain to Ameris Bank, as assignee of the Federal Deposit Insurance Corporation, as Receiver for Central Bank of Georgia (Lender), dated April 26, 2007 and recorded in Deed Book 148, Page 170, Schley County, Georgia records, as modified by that certain Modification of Deed to Secure Debt dated December 11, 2007 and recorded in Deed Book 156, Page 276, aforesaid records, as further modified by that certain Modification of Deed to Secure Debt dated October 16, 2008 and recorded in Deed Book 165, Page 312, aforesaid records, as further modified by that certain Modification of Deed to Secure Debt dated January 13, 2009 and recorded in Deed Book 168, Page 35, aforesaid records, as further modified by that certain Modification of Deed to Secure Debt dated March 10, 2010 and recorded in Deed Book 178, Page 216 aforesaid records, as last modified by that certain Modification of Deed to Secure Debt dated August 7, 2013 and recorded in Deed Book 212, Page 190, aforesaid records (collectively, the Security Deed), as transferred to Lender by that certain Assignment of Loan Documents recorded in Deed Book 206, Page 24, aforesaid records, conveying the after-described property to secure that certain Universal Note in the original principal amount of $43,353.50, as last amended, supplemented, restated, or otherwise modified by that certain Consumer Real Estate Secured Balloon Note dated August 7, 2013 in the outstanding principal amount of $90,779.00 (collectively, the Note), with interest thereon as set forth therein, there will be sold at public outcry to the highest bidder for cash before the courthouse door of Schley County, Georgia within the legal hours of sale on the first Wednesday in July, 2017, the following described property:
All that tract and parcel of land located in Land Lots 223, 255, and 256 of the 30th Land District of Schley County, State of Georgia, being further described as follows: STARTING at the intersection of the east land lot line of Land Lot 256 of the 30th Land District of Schley County, Georgia, and the south right of way of a paved county road traversing said land lot in its northeast corner and thence running North 57 40 03 West a distance of 57.59 feet to a point; thence running North 57 40 03 West a distance of 270.57 feet to a point; thence running along the right of way of a paved county road an arc distance of 615.08 feet (said arc having a chord distance of 611.79 feet and a chord bearing of North 47 24 20 West and said arc having a radius of 1717.09 feet) to a point which is the POINT OF BEGINNING. From said POINT OF BEGINNING, thence running North 37 08 37 West a distance of 328.64 feet to a point; thence running South 52 59 20 West a distance of 638.29 feet to a point; thence running South 74 5117 West a distance of 477.00 feet to a point; thence running South 02 35 30 West a distance of 1119.24 feet to a point; then running South 86 28 52 East a distance of 787.32 feet to a point; thence running North 02 35 30 East a distance of 1126.17 feet to a point; thence running North 52 5920 East a distance of 478.90 feet to a point which is the POINT OF BEGINNING.
Said property consisting of 25.75 acres and being further described as Tract 3 on a plat of survey captioned Property of Ronnie Albritton & Others, dated May 5, 1996, by Abb W. Preston, Registered Surveyor, and being recorded in the records of the Clerk of Superior Court of Schley County, State of Georgia, in Plat Book 6, Page 16, said plat is made a part of this description by reference.
Said property is subject to all easements, rights of way and restriction on record.
The above described property includes the permanently affixed 1997 Fleetwood Hickory Homes Manufactured Home that has been converted to real property pursuant to those certain Mobile/Manufactured Home Certificates of Permanent Location recorded in Deed Book 213, Page 291, aforesaid records and Deed Book 213, 292, aforesaid records.
The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in Security Deed and by law, including attorneys fees (notice of intent to collect attorneys fees having been given).
Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
The entity that has full authority to negotiate, amend, and modify all terms of the mortgage with the debtor is: Ameris Bank, Mike Nicotra, 7825 Baymeadows Way, Suite 200-A, Jacksonville, FL 32256; (904) 292-3733. Please understand that the secured creditor is not required by law to negotiate, amend, or modify the terms of the mortgage instrument.
To the best knowledge and belief of the undersigned, the party in possession of the property is Rebecca Ann Sinquefield f/k/a Rebecca Ann Fountain or a tenant or tenants and said property is more commonly known as 3507 Green Road, Ellaville, GA 31806.
The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the security deed.
