NOTICE OF SALE UNDER POWER
STATE OF GEORGIA
COUNTY OF CHATTOOGA

Under and by virtue of the power of sale contained in a Deed to Secure Debt given by Crystal Nichols to John Rufus Johnson dated June 28, 2013, recorded in Deed Book 617, Page 247, Chattooga County, Georgia Superior Clerks Office, conveying the after described property to secure a note with interest thereon as set forth therein, there will be sold at public outcry to the highest bidder for cash before the Courthouse door in Chattooga County, Georgia, within the legal hours of sale upon the first Tuesday in June, 2017, (June 6, 2017) and continuing from day to day until sold, the following described property, to-wit:
TRACT I:
All that tract or parcel of land lying and being in Land Lot 57 in the 6th District and 4th Section of Chattooga County, Georgia being Lot 29 in Addition #1 to Hinton Subdivision #1 as shown on a Plat recorded in Plat Book 4, Page 170, in the Office of the Clerk of Superior Court of Chattooga County, Georgia and being more particularly described as follows:
BEGINNING at a point on the east side of Maple Street, said point being 300 feet north from the intersection of the east side of Maple Street with the north side of Selman Way; thence north 100 feet along the east side of Maple Street to a point; thence east 150 feet to a point; thence south 100 feet to a point; thence west 150 feet to the point of beginning, according to a Plat by H.L. Campbell dated August 7, 1973.
TRACT II:
All that tract or parcel of land lying and being in Addition No. One to Hinton Subdivision No. One and being in Land Lot 52 or 57 in the 6th District and 4th Section of Chattooga County, Georgia and recorded in Plat Book 4, Page 170, Chattooga County Deed Records, and being more particularly described as follows:
BEGINNING at a point, said point being the northeast corner of Subdivision Lot No. 29; thence east 150 feet; thence south 100 feet; thence west 150 feet to the southeast corner of Subdivision Lot No. 29; thence north 100 feet to the point of beginning.
TRACT III:
All that tract or parcel of land lying and being in the 6th District and 4th Section of Chattooga County, Georgia and in Land Lots 52 and 57 and being a part of the Hinton Subdivision Number 1 and being Lots 30, 31, 32, 33 and a 40 foot street located south of Lot Number 30 and more particularly described as follows:
BEGINNING at a point on the east side of Maple Street which point is 155 feet, more or less, south of the intersection of the south side of East Street with the east side of Maple Street and running thence south along the east side of Maple Street 440 feet, more or less, to a point; thence east 300 feet, more or less, to a point; thence north 40 feet, more or less, to a point; thence north 400 feet, more or less, to a point; thence west 250 feet, more or less, to the point of beginning.
The debt secured by said Deed to Secure Debt is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the note and Deed to Secure Debt, failure to maintain hazard insurance, and failure to pay ad valorem taxes are required by law. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the Deed to Secure Debt and by law, including attorneys fees (notice of intent to collect attorneys fees having been given).
To the best of knowledge and belief of the undersigned, the party (or parties) in possession of the subject property known as 153 Maple Drive, Summerville, Georgia 30747 is Crystal Nichols, and or tenant, or present occupant.
Said property will be sold subject to (a) any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), (b) any matters which might be disclosed by an accurate survey and inspection of the property, and (c) all matters of record superior to the Deed to Secure Debt first set out above, including, but not limited to assessments, liens, encumbrances, zoning ordinances, easements, restrictions, covenants, etc.
The sale will be conducted subject to (1) confirmation that the sale is not prohibited under the U.S. Bankruptcy Code; (2) O.C.G.A. Section 9-13-172.1; and (3) final confirmation and audit of the status of the loan with the holder of the security deed.
Pursuant to O.C.G.A. Section 9-13-172.1, which allows for certain procedures regarding the rescission of judicial and nonjudicial sales in the State of Georgia, the Deed Under Power and other foreclosure documents may not be provided until final confirmation and audit of the status of the loan as provided in the preceding paragraph.
Crystal Nichols has been notified in accordance with Georgia Law that attorneys fees will be collected for the default in payment of said note, and has been further notified in accordance with O.C.G.A. 44-14-162 through 44-14-162.4 that foreclosure proceedings have been instigated against this property be sending a copy of the legal advertisement prior to 30 days before the date of sale, by certified mail to the property address or such other address as the debtor may designate by written notice to the secured creditor. The person who shall have full authority to negotiate, amend and modify all terms of the deed to secure debt with the debtor, together with their telephone number is as follows:

The property will be sold as the property of the makers of said Deed to Secure Debt or their assigns, in bar of all equity or redemption, and will divest all of the right, title and interest of the makers thereof, or their assigns, in and to said property, and shall invest such title in the purchaser.
The proceeds of said sale will be used first to the payment of expenses of said sale, including those attorneys fees provided by said Deed to Secure Debt and/or that note secured thereby; the payment of said note, principal and interest; and the balance, if any, will be distributed as provided by law.
THIS IS AN ATTEMPT TO COLLECT A DEBT, ANY INFORMATION OBTAINED WILL BE USED FOR THAT PURPOSE.
