STATE OF GEORGIA COUNTY of GLYNN NOTICE OF SALE UNDER POWER By virtue of the power of sale contained in that certain Deed to Secure Debt from HUMBERTO QUINTERO to MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INC. AS NOMINEE FOR HOMEOWNERS MORTGAGE ENTERPRISES, INC dated August 22, 2012, filed for record August 28, 2012, and recorded in Deed Book 3040, Page 353, GLYNN County, Georgia Records, and as modified by that certain Loan Modification Agreement recorded in Deed Book 3513, Page 1, GLYNN County, Georgia Records, as last transferred to FRANKLIN AMERICAN MORTGAGE COMPANY by assignment recorded in Deed Book 3685, Page 419, GLYNN County, Georgia Records. Said Deed to Secure Debt having been given to secure a Note dated August 22, 2012 in the original principal sum of ONE HUNDRED THIRTY NINE THOUSAND EIGHT HUNDRED THIRTY SIX AND 0/100 DOLLARS ($139,836.00), with interest from date at the rate stated in said Note on the unpaid balance until paid, there will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door at GLYNN County, Georgia, or at such place as has or may be lawfully designated as an alternative location, within the legal hours of sale on the first Tuesday in May, 2017, the following described property: ALL OF THAT CERTAIN LOT, TRACT OR PARCEL OF LAND SITUATE, LYING AND BEING IN THE 1356TH DISTRICT, GLYNN COUNTY, GEORGIA, AND BEING FULLY DESCRIBED AND IDENTIFIED UPON A PRINT OF A PLAT OF SURVEY SHOWN BEING MADE FOR ?MRS. E. M. SELLERS? BY C.H. BLISS ON NOVEMBER 24, 1958, WHICH IS ATTACHED TO A CONVEYANCE FROM JAMES L. HARDEE, AS THE PARTIES OF THE FIRST PART AND MRS. JEAN SELLERS AND E.M. SELLERS, AS THE PARTIES OF THE SECOND PART, DATED DECEMBER 2, 1958, AND RECORDED IN THE PUBLIC RECORDS OF GLYNN COUNTY, GEORGIA, IN DEED BOOK 8-X, PAGE 109, AND BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS, TO-WIT: BEGINNING AT A POINT ON THE SOUTHERLY LINE OF HARDEE DRIVE WHICH POINT IS 530 FEET EASTERLY MEASURED ALONG SAID SOUTHERLY LINE OF HARDEE DRIVE LINE FROM POINT OF INTERSECTION OF THE EASTERLY LINE OF GLOVER DRIVE WITH SAID SOUTHERLY LINE OF HARDEE DRIVE AND FROM SAID BEGINNING POINT RUNNING SOUTH 26 DEGREES WEST 163 FEET; THENCE SOUTH 64 DEGREES EAST 210 FEET; THENCE NORTH 26 DEGREES EAST 163 FEET; THENCE NORTH 64 DEGREES WEST 210 FEET TO THE BEGINNING POINT. SAID REAL PROPERTY IS THE SAME REAL PROPERTY DESCRIBED IN THE CONVEYANCE FROM JAMES. L. HARDEE TO MRS. JEAN SELLERS AND E.M. SELLERS HEREINABOVE MENTIONED AND IS A PORTION OF A LARGER TRACT CONVEYED BY GEORGIA TRADING AND DEVELOPMENT COMPANY TO JAMES L. HARDEE ON JANUARY 5, 1923 BY A DEED RECORDED IN SAID PUBLIC RECORDS IN DEED BOOK 3-P, PAGE 495. REFERENCE IS HEREBY MADE TO SAID CONVEYANCE AND TO SAID PLAT AND TO THE RECORD OF EACH FOR FURTHER DESCRIPTION AND IDENTIFICATION OF SAID REAL PROPERTY AND FOR ALL OTHER PURPOSES. PARCEL ID-03-03809 To the best of the knowledge and belief of the undersigned, the party in possession of the property is HUMBERTO QUINTERO or a tenant or tenants. Said property may more commonly be known as: 117 HARDEE ROAD, BRUNSWICK, GA 31520. The debt secured by said Deed to Secure Debt has been and is hereby declared due because of, among other possible events of default, non-payment of the monthly installments on said loan. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, including attorney's fees (notice of intent to collect attorney's fees having been given). Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, whether or not now due and payable), the right of redemption of any taxing authority, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above. The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the Security Deed. Pursuant to O.C.G.A. Section 9-13-172.1, which allows for certain procedures regarding the rescission of judicial and nonjudicial sales in the State of Georgia, the Deed Under Power and other foreclosure documents may not be provided until final confirmation and audit of the status of the loan as provided in the preceding paragraph.
