NOTICE OF FORECLOSURE SALE UNDER POWER GWINNETT COUNTY, GEORGIA THIS IS AN ATTEMPT TO COLLECT A DEBT. ANY INFORMATION OBTAINED WILL BE USED FOR THAT PURPOSE. Under and by virtue of the Power of Sale contained in a Security Deed given by Maria Estrada and Juan Carlos Ochoa to Fidelity National Mortgage, a Division of Fidelity National Bank, dated September 24, 2001, and recorded in Deed Book 24751, Page 0178, Gwinnett County, Georgia Records, subsequently re-recorded April 9, 2002 in Book 27022, Page 0106 Gwinnett County, Georgia Records, as last transferred to SunTrust Mortgage, Inc. by assignment recorded on February 13, 2015 in Book 53381 Page 430 in the Office of the Clerk of Superior Court of Gwinnett County, Georgia Records, conveying the after-described property to secure a Note in the original principal amount of One Hundred Eight Thousand One Hundred Thirty-Eight and 0/100 dollars ($108,138.00), with interest thereon as set forth therein, there will be sold at public outcry to the highest bidder for cash before the courthouse door of Gwinnett County, Georgia, within the legal hours of sale on May 2, 2017, the following described property: All that tract or parcel of land lying and being in Land Lots 198 and 187 of the 6th District of Gwinnett County, Georgia, being Lot 40, Block E, Unit Two of Country Downs Subdivision, as per plat recorded in Plat Book 8, Page 259, as revised in Plat Book 15, Page 295, Records of Gwinnett County, Georgia, which plat is incorporated herein by reference and made a part of this description. The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in Security Deed and by law, including attorneys fees (notice of intent to collect attorneys fees having been given).
