NOTICE OF SALE UNDER POWER On or about August 28, 2015, ASHAR MUNAWAR executed and delivered a real estate Promissory Note and Deed to Secure Debt for the principal sum of FIVE HUNDRED NINETY-FIVE THOUSAND AND 00/100S ($595,000.00) to JP CAPITAL & INSURANCE, INC., P.O. Box 767, Jackson, GA 30233, which Note bearing interest thereon at the rate stated in said Note on the unpaid balance until paid. Said Deed to Secure Debt is recorded in Deed Book 1148, Page 330, in the Office of the Clerk of Superior Court, Fannin County, Georgia. Time was made the essence of the contract, and said Note contained a provision for payment of fifteen percent (15%) of the unpaid principal and interest as attorneys' fees if the claim be placed in the hands of an attorney for collection. In order to secure the payment of said Note, ASHAR MUNAWAR executed and delivered a Deed to Secure Debt to JP CAPITAL & INSURANCE, INC. conveying the following described tract of land, to-wit: TRACT ONE (7345 MURPHY HWY.): All that tract or parcel of land lying and being in the 8th District, 1st Section of Fannin County, Georgia, and being a part of Land Lot 8, containing 4.0 acres as shown on that Plat of Survey prepared for Rex and Dianne Killian by Donald L. Cordell, G.R.L.S. No. 2447, dated May 2, 1997, recorded in Plat Hanger A-323, Page 7, in the Office of the Clerk of Superior Court of Fannin County, Georgia. Said plat is incorporated herein by reference thereto for a more complete metes and bounds description. Being a portion of the property conveyed to Gerald Ray Davenport and Louise R. Davenport by Survivorship Deed of Arlin Moore dated October 27, 1992, and recorded in Deed Book 191, Page 252, in the Office of the Clerk of Superior Court of Fannin County, Georgia. And being the same property as being described in Deed Book 305, Page 541, Fannin County, Georgia Records and Map Parcel Number 0009 005 01 Bill Number 014024. TRACT TWO (500 APPALACHIAN HWY.): All that tract or parcel of land lying and being in Land Lot 65 of the 7th Land District, Fannin County, Georgia Records and more particularly described in Survey made for Novella Thomas and Shirley Ann Panter and prepared by Joel Jordan dated February 14, 1996 and recorded in Plat Book HA 246, Page 5, Fannin County Records. Said plat is incorporated herein for a more accurate description of the property conveyed. SAID PROPERTIES ARE KNOWN AS 500 APPALACHIAN HWY., BLUE RIDGE, GA 30513 and 7345 MURPHY HWY., MINERAL BLUFF, GA 30559 ACCORDING TO THE PRESENT NUMBERING SYSTEM IN FANNIN COUNTY, GEORGIA. Because of a default in making payments on said Note, JP CAPITAL & INSURANCE, INC., pursuant to the provisions of said Note and Deed to Secure Debt, securing the same, has exercised its option and declared the entire balance due and collectible. Notice fixing the liability for attorneys' fees has been given according to law. Said property is being sold subject to all taxes, interest, liens and parties and possession, etc. Said Deed to Secure Debt contains a power of sale authorizing the Grantee, as Attorney in fact for Grantor therein, to sell the property described above in order to satisfy said Note, as well as subsequent advances, after advertising the same once a week for four (4) weeks in the official gazette of said County. In accordance with said Power of Sale and by virtue thereon, JP CAPITAL & INSURANCE, INC. will sell the property described above at public outcry to the highest bidder for cash, on the first Tuesday in May 2017, before the Fannin County Courthouse door, the place of public sales in Blue Ridge, Fannin County, Georgia, and within and during the legal hours of sale. The proceeds of the sale will be used as follows: (1) To pay the expense of said sale; (2) To pay the sums secured by said Security Deed; (3) The balance, if any, to the appropriate parties.
