STATE OF GEORGIA COUNTY OF FANNIN NOTICE OF SALE UNDER POWER Under and by virtue of the power of sale contained in a Security Deed from SANDRA ARP to UNITED COMMUNITY BANK, dated August 13, 2010, recorded August 18, 2010, in Deed Book 937, Page 610, Fannin County, Georgia records, said Security Deed being given to secure a Note from SANDRA ARP dated August 13, 2010, in the original principal amount of Sixty Eight Thousand One Hundred Eighteen and 30/100 ($68,118.30) Dollars, with interest from date at a rate per cent per annum on the unpaid balance until paid; there will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door at Fannin County, Georgia, within the legal hours of sale on the first Tuesday in May, 2017, the following described property: All that tract or parcel of land lying and being in Land Lot 266 of the 8th District and 1st Section of Fannin County, Georgia, containing 2 acres, more or less, and being more particularly described as follows: beginning at the land lot corners common to Land Lots 266, 267, 274 & 275; thence north 2 degrees 58 minutes 06 seconds east 588.2 feet to the centerline of a gravel drive, this being the true point of beginning; thence following the centerline of the gravel drive three (3) courses and distances, south 85 degrees 06 minutes 32 seconds west CH 42.98 feet; south 79 degrees 44 minutes 22 seconds west 93.01 feet, south 87 degrees 55 minutes 59 seconds west CH 73.76 feet; thence north 1 degree 59 minutes 16 seconds east 417.71 feet; thence north 87 degrees 03 minutes 04 seconds east 214.89 feet to a point; thence south 2 degrees 58 minutes 06 seconds west 406.18 feet to the true point of beginning. Subject to a driveway on a southern boundary. There is affixed hereto a 1988 north river 52 x 28 mobile home with manufacturer's ID No. ALNR11875228S7296A and ALNR11875228S72968, which is included in the conveyance of this property. This conveyance shall be subject to all zoning ordinances, covenants, conditions, restrictions, easements and rights of way of record, if any. The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the Security Deed and by law, including attorney's fees (notice of intent to collect attorney's fees having been given). Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, easements, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
