NOTICE OF SALE UNDER POWER, Ben Hill County Pursuant to the Power of Sale contained in a Security Deed given by Theresa Hutchinson and Fairley Jack Hutchinson to Mortgage Electronic Registration Systems, Inc. as a nominee for Southpoint Financial Services, Inc. dated 3/24/2006 and recorded in Deed Book 626 Page 159 Ben Hill County, Georgia records; as last transferred to or acquired by Deutsche Bank National Trust Company, as Trustee for Saxon Asset Securities Trust 2006-2 Mortgage Loan Asset Backed Certificates, Series 2006-2, conveying the after-described property to secure a Note in the original principal amount of $ 118,800.00, with interest at the rate specified therein, there will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door of Ben Hill County, Georgia (or such other area as designated by Order of the Superior Court of said county), within the legal hours of sale on May 02, 2017 (being the first Tuesday of said month unless said date falls on a Federal Holiday, in which case being the first Wednesday of said month), the following described property: A certain tract or Parcel of land lying and being in Land Lot Number One Hundred Eighteen (118) in the Third Land District of Ben Hill County, Georgia, and being all of Lot Number Nine (9) in Roanoke Acres Subdivision Number Seven (7) as shown on a plat dated June 23, 1964, and recorded June 27, 1964, in Plat Book 5, Page 2 in the office of the Clerk of the Superior Court of Ben Hill County, Georgia, and said plat is hereby made a part hereof as fully as if attached hereto and the property hereby conveyed has a frontage on that certain public street known as West Roanoke Drive Extension of 155 feet. This instrument is subject to a power line easement across the North Seven and one-half feet of said property. This instrument is also subject to an easement across the East 15 feet of said lot granted by Davis Y. Sims to O. W. Lewis, Jr. by written agreement dated September 29, 1967, and recorded on October 17, 1967, in Deed Book 113, Page 156, in the office of the Clerk of the Superior Court of Ben Hill County, Georgia The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the Security Deed and by law, including attorney's fees (notice of intent to collect attorney's fees having been given). Said property is commonly known as 1171 West Roanoke Drive, Fitzgerald, GA 31750 together with all fixtures and personal property attached to and constituting a part of said property, if any. To the best knowledge and belief of the undersigned, the party (or parties) in possession of the subject property is (are): Theresa Hutchinson and Fairley Jack Hutchinson or tenant or tenants. The sale will be conducted subject to (1) confirmation that the sale is not prohibited under the U.S. Bankruptcy Code; and (2) final confirmation and audit of the status of the loan with the holder of the Security Deed.
