NOTICEÂ OFÂ SALEÂ
UNDERÂ POWER
STATE OF GEORGIA,
COUNTY OF PIKE.
Notice is hereby given that pursuant to the power of sale contained in a Deed to Secure Debt executed and delivered on September 21, 2016, by WAYNE L. HOPPER AND AMANDA M. HOPPER, as Grantor, to TMI REALTY, LLC, as Grantee, and recorded in Deed Book 1050, Page 274, Pike County Superior Court records, and by virtue of default in payment in indebtedness therein mentioned, which has made the aforesaid power of sale operative and effective, the undersigned, TMI REALTY, as Attorney-in-fact for WAYNE L. HOPPER AND AMANDA M. HOPPER will sell at public outcry before the Courthouse door in Pike County, Georgia, on Tuesday, May 2nd, 2017, during the legal hours of sale, to the highest bidder for cash, the property described in said Security Deed to-wit:
All that tract or parcel of land containing .20 acre(s) located in Land Lot 226 in the 9th Land District Of Pike County, Georgia, being further known as Pike County Tax Assessor's number 020A-041 and more particularly described as that .50 acres conveyed by Deed Book 53, Page 28, Records of Pike County, Georgia, less and except that .30 acres conveyed in Deed Book 497, Page 301, aforesaid Records, and as shown at Plat Book 21, Page 195 of the aforesaid Records, said property being further known as 233 McCrary Road, Molena, Georgia.
Notice of the initiation of proceedings to exercise the power of sale in the Deed to Secure Debt hereinabove referenced has been given and of Grantee's intention to collect attorney's fees in connection herewith as required by law.
The note executed on September 22, 2016, by Wayne L. Hopper and Amanda M. Hopper, as Grantor, to TMI Realty, LLC, as Grantee, and secured by said Deed to Secure Debt and assignments, is now in default and the said TMI, LLC, does so elect that said indebtedness, with principal and interest, become due and payable at once.
The said property shall be sold subject to all outstanding taxes and assessments against said property.
The proceeds from said sale shall be distributed as follows:
(1) to pay the expense of said sale;
(2) to pay all indebtedness secured by said Deed to Secure Debt;
(3) to pay attorney's fees; and
(4) to distribute any excess proceeds as provided by law.
